33.) Exhibit L indicates 330 acres will need topsoil replacement and revegetation. Please <br />explain what these 330 acres will consist of? For example, will this include embankment <br />side slopes, overburden stripping/stockpile areas, and the plant/processing area. Is this <br />330 acres of disturbance associated with the construction of pond Cl? <br />34.) The Division is still in the process of reviewing the embankment proposal, and <br />considering the bonding option proposed in the application. <br />35.) In order be eligible for the 20% bonding option for the slurry wall installation for the <br />previously mined areas, please commit to providing a final construction report detailing <br />the instillation of the slurry wall. This report must include a description of any problems <br />that occurred during installation, a listing of the results of testing that was conducted <br />under the approved quality assurance/control plan, and an engineer certification. <br />36.) Given mining is occurring in cell C1 and B, the Operator may be eligible for the 20% <br />bonding option for these cells at this time. Please state the length of each of these <br />slurry walls and an estimate of the maximum depth the slurry walls will be constructed. <br />37.) For the un-mined areas, please commit to not exposing groundwater until the slurry <br />wall has been installed. In Exhibit L, under bullet three, the applicant committed to <br />conducting in-situ testing prior to exposing groundwater to determine if the slurry wall <br />meets the SEO standards. In order for the financial warranty to be completely waived <br />for these areas, the applicant must commit to obtaining SEO certification of the slurry <br />wall prior to exposing ground water. Please specifically identify which cells the Operator <br />intends the financial warranty to be waived for slurry wall construction. <br />6.4.15 EXHIBIT O - Owner(s) of Record of Affected Land (Surface Area) and Owners of <br />Substance to be Mined <br />38.) Please clarify, does Gilcrest Reservoir, LLC own the entire property located within <br />the permit boundary? <br />6.4.19 EXHIBITS- Permanent Man-Made Structures <br />39.) Please submit a list of permanent Man-Made Structures on or within 200 feet of the <br />affected land. Each of these structures will need to be displayed on the Exhibit C map. <br />Please indicate who owns each structure. <br />40.) Please indicate which structures will be relocated during the mining operation. For <br />each structure to be relocated the applicant must submit a copy of the agreement the <br />applicant has with the owner of the structure giving them permission to relocated the <br />structure. For example, there are numerous gas lines within the permit area. Exhibit C <br />indicates the Operator will mine though and relocated existing gas lines, specifically in <br />mining cell A, B, and C1. Also, there appears to be a tank/equipment located in cell C2
