• DILL PIT <br />Exhibit C <br />h) The only water to be used will be that amount possibly necessary for dust <br />control which can be supplied by the operator. The water will be supplied from off-site <br />or from an existing pond on the property. The existing pond on the property is <br />approximately 0.40 miles to the southeast and is not located within the permit boundary. <br />It is anticipated that a total of 300 to 500 gallons per week will be used for dust control. <br />The State of Colorado Department of Natural Resources Division of Water Resources <br />was contacted and they gave permission to use the pond water for the needed dust control. <br />A copy of the Division of Water Resources letter is included as Exhibit "F" of this permit <br />application. Sanitary sewer water will not be used or needed. Porta-John Toilets are to be <br />used. Drinking water will be bottled and imported to the site daily, when people are <br />working. <br />i) The pit will be excavated to a total depth of approximately 10 to 25 feet, to a <br />minimum 2' above groundwater. A previously used and reclaimed pit on the property <br />had groundwater at an approximate depth of 12' below the low grade on the site. The pit <br />will not be excavated to the groundwater. The sand and gravel deposits will be excavated <br />to a minimum two feet above the groundwater depth and as far laterally as possible. <br />Maintaining the minimum 2' of soil above the groundwater elevation, a well permit and <br />substitute water supply plan (SWSP) from the Office of the State Engineer will not be <br />required. The existing overburden soils on the property will be used to construct the <br />needed final 4 H:1 V slopes. The only water involved will be that amount on the surface <br />of the permit area and the amount that will flow through the permit area from the swale <br />from the southwest, and a Stormwater Discharge Permit will be acquired to deal with this <br />small amount, if needed. The owner/operator of the pit will not have any fuel storage <br />containers in the permit area. The existing fuel tanks at the owner's house site will be <br />used. If a contractor would move in a portable asphalt plant, they (the contractor) would <br />need to abide by the Spill Prevention Control and Countermeasures (SPCC) Plan of the <br />land owner. The SPCC plan will be implemented prior to storage of fuel or oil products. <br />Any containment structures used will not be permanent. <br />j) The Stormwater Discharge Permit that will be acquired will deal with <br />compliance with applicable Colorado water laws and regulations governing injury to <br />existing water rights. Because the final groundcover will not be changed with <br />reclamation, it is anticipated that the historical flows of storm water will not be affected. <br />k) No refuse or acid and toxic producing materials will be exposed during mining <br />so no plan is needed. If any refuse is encountered it will be disposed of off-site in an <br />approved landfill. <br />•
