1. The individual or company, other than the mine operator, delivering material to the <br />facility will be required to sign an affidavit certifying that the material is: clean and inert, <br />the originating source of the material, and the estimated volume. At the discretion of <br />the facility operator, the certification may also include an environmental audit of the <br />source site prepared by a Colorado Registered Professional Engineer or a Registered <br />Environmental Manager. <br />2. During the stockpiling process, the facility manager and those individuals who operate <br />the stockpiling equipment will conduct constant visual analysis of the delivered material <br />on a truck by truck basis. At a minimum, the visual evaluation will identify that the soil <br />does not have any hydrocarbon contamination, hazardous substances, or other solid <br />waste. <br />3. In the event that contaminated material is identified, all work in the immediate area will <br />cease and a Colorado Registered Professional Engineer or a Registered Environmental <br />Manager will be contacted by the facility operator. The qualified individual(s) will <br />prepare, supervise and implement a Remediation and Disposal Plan conducted in <br />accordance with the requirements of the governing regulatory agencies. <br />Once approximately 20,000 tons of used asphalt pavement and concrete rubble may been <br />stockpiled on -site where it will then be crushed to proper size, and stockpiled for use as <br />recycled materials in new construction. <br />HAUL ROAD - Private drive access to the site is gained from State Highway 141 which is well <br />maintained and in good repair. The alignment of the existing haul route extends to the mine <br />floor and is shown on the accompanying Mining Plan Map. As extraction of the resource occurs <br />the existing haul road will be extended across the mine floor. <br />If necessary, speed limit and other traffic control signs will be installed along the entire length <br />of the haul road and within the mine site. Water will be used on a continual basis to control <br />dust on the haul road and within the mining area. <br />WATER DIVERSIONS and IMPOUNDMENTS - The predominant drainage course found in the <br />vicinity is West Creek, which is approximately 350 feet south of the permit boundary and flows <br />approximately 80 feet below the site. <br />The site is somewhat affected by the potential of flooding from land north of the permit <br />boundary. Two intermittent drainage channels cross the property and flows across the site to a <br />series of culverts that convey water under State Highway 141 to West Creek. <br />Rev. 02125/10 4 <br />
