The Environmental Protection Plan in Exhibit T notes specific requirements for the <br />assessment of and protection of surface and groundwater which includes adherence to <br />Rule 3.1.6 and 7. <br />Rule 3.1.6 water-general requirements: Addressed in Exhibit T <br />Rule 3.1.7 groundwater: addressed in Exhibit T <br />Rule 3.1.8 Wildlife: DRMS notes an Environmental Assessment is required by <br />BLM as part of its permit process. Impacts to wildlife are fully vetted in that <br />process. A list of potential T&E is submitted noting no critical habitat within <br />the Last Chance Mine Area. Critical habitat does exist downstream from the <br />area but proposed surface water controls, distance, and a lack of conveyance <br />to the area make impacts unlikely. <br />(1) No activity restrictions are noted within the submitted plans. <br />(2) Reclamation is for rangeland. The seed mix recommended by BLM has shrubs and <br />grasses that are beneficial to wildlife. Reclamation will be done to encourage cover <br />and feed for small mammals and birds. <br />Rule 3.1.9 (1), Topsoil: <br />(1) Please confirm that any topsoil left in place for more than 180 days or one <br />growing season will be protected from wind and water erosion with the <br />temporary seed cover proposed in the reclamation plan. <br />(2) Please clarify what will be done with woody vegetation if disturbed. <br />(3) Stockpiled topsoil is noted in specific locations and relocation is not proposed during <br />mining. <br />(4) Final reclamation notes grading and tilling to prevent zone slippages. <br />(5) Topsoil and topsoil like materials have been salvaged during the Notice of Intent <br />process as required. <br />(6) Total available topsoil quantities and depth have not been established but is <br />brought up as part of this review. <br />(7) See 3 above. <br />Rule 3.1.10, Revegetation: <br />(1) Revegetation diversity is being submitted with BLM recommendations for final use. <br />(2) is not applicable, <br />(3) Please commit to ensuring no livestock will be permitted on site until the <br />permit or area is released by DBMS. <br />(4) see (1) <br />(5) Noted in Exhibit E. <br />(6) Noted in Exhibit E <br />(7) Not applicable. <br />(8) No exemptions are noted at this time. <br />(9) is not applicable. <br />Rule 3.1.11: Please provide a response to comments from the Office of <br />Archeology received 4127109.
