7. It is our intent to operate this quarry continuously during the months that weather <br />permits. We currently have a 1o year lease with the option to renew for two additional 5 <br />year terms and we plan to fulfill our lease. <br />8. The Mine Plan Map has been revised to show the proposed location of an asphalt <br />/concrete batch plant. On January 26, 2010 the Grand County Board of County <br />Commissioners approved our Special Use Permit which does allow for both asphalt and <br />concrete batch plants. We will forward a copy of the Special Use Permit as soon as a <br />permit is provided to us. We will also forward to you a copy of the Air Pollutant <br />Emission Notice (ADEN) permit and Hazardous material and Spill Control permits prior <br />to operating the asphalt/concrete plant. <br />9. At this time we are not intending to provide washed products. If the need for these <br />products should arise in the future we will submit a technical revision to the permit per <br />Rule 1.9 prior to construction of a wash pond. <br />10. Per Rule 3.1.9 we will segregate top soil and overburden. Stockpiles are noted on the <br />Mining Plan. <br />11. The location of the scale house has been moved and is now located inside the north <br />boundary. Location is noted on the Mining Plan Map. <br />12. We have contacted the Grand County Department of Natural Resources for input on a <br />weed control plan for our permitted area. Since we will be stripping the topsoil and <br />overburden from the mining area and placing in stockpiles those piles will be reseeded, <br />with the seed recommendations from the NRCS included in our reclamation plan, no <br />later than October 2010. This reseeding deadline was a condition of our Grand County <br />Special Use Permit. The reseeding should help growth of the desirable plants over <br />undesirable plants. Any additional problems with noxious weeds will be handled next <br />by mechanical methods, or mowing when they would reach a height of 6 to 12 inches. <br />Should weed problems continue the next method of controlling would be contact the <br />Grand County Department of Natural Resources and apply chemicals recommended by <br />the NRCS. <br />13. During reclamation we will mulch all areas with two tons of mulch per acre. <br />14. All wells were identified on Exhibit G-1 and listed on the Colorado Division of Water <br />Resources list. There are no wells within 600 of the permitted area. <br />15. We have applied for the Stormwater Discharge Permit and will supply the MLRB a copy <br />of the permit once received. <br />16. We have reviewed the reclamation cost estimate you prepared but are asking that you <br />now recalculate the amount of bond required due to the change in the mining plan. <br />When calculating we ask that you please consider the fact that we will only be stripping <br />the east 1/2 of the permitted area during Phase I-A Once we have completed mining
