III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> RDA expansion Topsoil salvage..........................................Sediment control measures for 6RT underflow drill pad <br /> Ponds throughout the mine site are frozen and not discharging. Repairs to Pond D embankment and riser <br /> have been completed. TCC will need to submit to the Division an as-built certification for Pond D to <br /> document the repairs were conducted in accordance with the approved design or provide a letter to the <br /> Division documenting the repairs conducted and certified by the engineer. Pit 1 was discharging to Pond D. <br /> And Pond D was discharging 0.25 on the staff gauge. Discharge was clear and no problems noted. <br /> TCC r�g a winter exemption from MSHA for MSHA pond inspections for Pond A, D, and G.& h MN I�-6- <br /> Fish Creek Bore Hole ponds were not discharging to Fish Creek at Site 1 I5. FCBH was not pumping to the <br /> barricade chamber.Nor was FCVS pumping occurring. TCC personnel noted that 10 days previous water <br /> level measured at the FCVS recorded 29.83 feet of freeboard. The Million Gallon tank at the PM Bay had <br /> spilled over and had ice build up on the side at the time of the inspection. As a result of the Million Gallon <br /> tank spill over, Pond G showed evidence of discharge. Pond F was frozen and snow covered but did not <br /> appear to contain a pool of water. <br /> Pond B was frozen and not discharging. Haul road runoff that runs into the Pond B pad area was passing <br /> through the culvert and into the sediment trap as designed. This set up is working well. The Truck Loadout <br /> drainage is flowing to Pond C. Downcutting of the slope has occurred. TCC will need to address this <br /> downcutting, though everything is contained in Pond C. TCC will also need to watch how snow is cleared <br /> from the truck Loadout area to assure that flow continues to be directed to the appropriate location. <br /> Train Loadout coal overfill material has been pushed up and will be hauled to the refuse pile. Visual <br /> markers requested by the Division at the edge of the stream buffer zone have not been placed. Although the <br /> stream buffer marker is in place, additional definition of the buffer zone is needed to assure winter activities <br /> in this location do not encroach into the buffer zone. <br /> 4MB WHITE-File YELLOW-Operator PINK-Specialist <br />
