§2.05 APPLICATION FOR PERMIT FOR SURFACE OR UNDERGROUND MINING <br />ACTIVITIES --MINIMUM REQUIREMENTS FOR OPERATION AND RECLAMATION <br />PLANS. <br />(2) Fish and Wildlife Plan. <br />(a) Refer to Volume I -Text, Section 2.05.6(2)(a) for a permit wide <br />discussion concerning the mitigation of the effects of mining on fish and <br />wildlife. <br />(b) See Map 7 for the layout of sedimentation controls. <br />(c) No answer required. <br />(3) Protection of Hydrologic Balance. <br />(a) Required protection information. <br />(i) The quality of surface and groundwater within and adjacent to <br />the permit area that may be affected by surface activities. <br />The operator has prepared a drainage and sediment control <br />system which will minimize changes to the surface water and to <br />the prevailing hydrologic balance in the facilities area by <br />detaining run-off in sediment ponds or treating runoff with <br />alternative sedimentation control. The sediment ponds are <br />designed to contain the run-off from the 10-yer, 24-hour <br />precipitation event. The sedimentation control plan is <br />presented on Map 7. <br />The Pavka Spring No. 1, water right number 9, is located north <br />of SH 133 as shown on Map 9. Since it is located above the <br />loadout it is unlikely the operation will affect the spring. The <br />Calnon W/W Ditch, water right number 3, is owned by a <br />property owner north of SH-133. Since it is located above the <br />loadout it is unlikely the operation will affect the waste water <br />ditch. <br />The remaining water rights are considered to be a suitable <br />TR-020 2.05 - 35 3/01 <br />
