§2.05 APPLICATION FOR PERMIT FOR SURFACE OR UNDERGROUND MINING <br />ACTIVITIES --MINIMUM REQUIREMENTS FOR OPERATION AND RECLAMATION <br />PLANS. <br />distance from the disturbed area to not be affected by surface <br />activities. <br />(ii) The rights of present users. <br />Map 9, Water Rights Location shows the water rights within the <br />permit and adjacent area of the train loadout and stockpile <br />areas. The loadout should not affect any water rights. The <br />loadout has been in operation for over 20 years. There is no <br />indication that any rights of present users have been affecteds <br />during this period and there is no reason to believe there will be <br />any affect on water right users in the future. <br />(iii) The quantity of surface and ground water. <br />Because no subsidence is predicted within the permit boundary <br />of the train loadout and stockpile areas, no impact to the <br />quantity of surface or groundwater is anticipated and <br />considered minuscule. <br />However, the applicant has alternative sources of water to <br />mitigate any impacts that these mining activities may have on <br />the quantity of surface and ground water within the permit <br />boundary of the train loadout and stockpile areas.
