Structures Approved for Permanent Retention <br />The Division has previously approved for permanent retention the structures listed below. <br />• Haul road and dirt road in former truck dump loadout area, and associated <br />structures, <br />• Sediment control pond at toe of former refuse disposal area, <br />• Rock-armored ditches D-9 and D-10 next to the refuse disposal area, <br />• Ditch A that extends from pond P-9 to the refuse area pond, <br />• Stony Ridge Fan site, road, and bridge over N. Thompson Creek, <br />• Developed Water Resources Area (4.1 acres, includes: Mine No. 1 monitoring <br />well M-8, Mine No. 3 monitoring well M-9, pipelines from Mines No. 1 and 3, Long <br />Pond, Pond T-1, Pond T-2, Pond P-9, inter-pond areas, and pipe and half-culvert <br />that connects the ponds). <br />Revegetation Success Standards <br />Section 4.4.2.3 of the permit application indicates that the flume sites in North and Middle <br />Thompson Creeks and piezometer sites D-lA and D-2A are located in areas where revegetation <br />success is to be determined by comparing sample transect data from the reclaimed lands to data <br />collected on the mine's reference area. The flume and piezometer sites, however, are too small for <br />quantitative sampling; therefore, revegetation success on these sites has been determined by visual <br />comparison with surrounding lands. <br />Submittal of Bond Release Application and <br />Completeness Determination by the Division <br />The Division received bond release application SL-6 on October 10, 2006, and found the application <br />complete on January 10, 2007, after the Division received proof of publication of the applicant's <br />public notice. The completeness determination was made in accordance with Section 3.03.2(1)(d). <br />Minrec submitted the bond release application following the procedures described in the Act and the <br />Regulations. The application also utilizes the Division's "Guideline Regarding Selected Coal Mine <br />Bond Release Issues", dated April 18, 1995. The application requests full Phases 1, 11, and III bond <br />release for the entire permit area, including all disturbed and affected areas. <br />Public Notice <br />Minrec published notice of the bond release application in the Glenwood Springs Post Independent <br />Sun once weekly for four consecutive weeks, beginning October 31, 2006. Minrec also notified <br />landowners within and adjacent to the mine permit area, and other interested parties of the bond <br />release application, as required by Section 3.03.2(1). <br />9
