Skye Sieber
t, Trey C Schillie/RVUSDAFS To Skye Sieber/R2/USDAFS@FSNOTES
- 09/14/2009 09:13 AM cc Wendy Haskins/R2/USDAFS@FSNOTES, Kenneth K
Tu/R2/USDAFS@FSNOTES
bcc
Subject Re: Fw: conger rock appeaILA
History: EV,, This message has been forwarded.
This document is an appeal filed pursuant to 36 CFR Part 215
The appellants' names are Thomas R. Mellish and George A. Howie, who reside at 48 Island
Lake Way, Marble, Colorado.
The appellants' telephone number is (970) 963-5165.
The Decision Document - Decision Notice and Finding of No Significant Impact: Conger Rock
Harvesting Project. There was no date on the document. There was a cover letter dated July
17, 2009 / File Code: 1950-1/2850.
Skye,
Ken Tu forwarded me your question about the Conger Rock decision. We did receive
another appeal in our inbox, I believe it was the day before the comment period ended.
This is the only other one that I am aware of at this time. We generally like to give the mail
five business days after closing to make sure there are no more hard copies coming our
way.
I have pasted the most recent appeal below (it is a short one). It looks like we will have a
Regional Appeal Review Team for this on the week of October 5th. Please let me know if
you have any questions.
Thanks,
Trey
Responsible Official: Irene L. Davidson, District Ranger
Design Criteria: According to the Public Involvement section, the responsible official stated:
"a majority of comments came from residents living near the project area, with primary
concerns related to noise and visual impacts. These concerns are what prompted me to
require adding the hours of operations stipulations." Yet the responsible official exacerbated
the noise problem by increasing the number of hours heavy equipment can operate. The
noise problem under the current environment was not evident prior to 8:00 am or after
5:00 pm. The design criteria in this document would allow operations from 7:00 am to 7:00
pm. This stipulation totally contravenes the noise concerns raised by all the residents of the
Marble Ski Area Filing No 7 and the Crystal River Subdivision.
1 of 4
