Skye Sieber
Furthermore, we contend that this project should be denied because it violates the Colorado
Noise Statute, provision 25-12-103. The screeching and grating by the heavy equipment
and the continual beeping more than exceeds 70 db(a), well over the 55 db(a) limit.
Finding of No Significant Impact: We disagree that this project has no significant impact on
the quality of the human environment. Besides the magnitude of the noise problem
identified above, we are concerned about the health of the Engleman Spruce and Douglas
Fir trees in the area. Already, there are dead trees in the private(staging area) of the
property. And we have been informed, by members of the Forest Service staff itself, that
Spruce Worms are the more serious threat(than pine beetles) in the Marble area. Therefore
the reference to the scarred landscape and staging area being shielded by existing stands of
trees may not exist at all within the next few years. This would seriously compromise the
Forest Plan position that states that " the Crystal River Corridor is a Class A area which
provides unusual, unique or outstanding scenic quality.
In addition, this project, if approved, would contravene the Upper Crystal River Special Area
Regulations. One of the primary directives of the UCR Special Area, is to protect the
environment by avoiding adverse impacts caused by land development.
Therefore, based on the above, we believe that this project be rejected by the Forest
Service.
Tom Mellish and Art Howie
48 Island Lake Way
Marble, Co - 81623
TREY SCHILLIE
Ecosystem Services Specialist
US Forest Service
Rocky Mountain Region, Regional Office
740 Simms Street
Golden, CO 80401-4702
303.275.5067 (phone)
303.275.5075 (fax)
tschillie@fs.fed.us
http://www.fs.fed.us/ecosystemservices
Kenneth K Tu/R2/USDAFS
Kenneth K Tu/R2/USDAFS
09/14/2009 08:45 AM To Trey C Sch illie/R2/USDAFS@ FS NOTES
cc
Subject Fw: conger rock appeal
2of4
