(ERC) provides this additional information as part of the Pre-
Construction Notification submitted to the Army Corps of Engineers (Corps) dated 10-22-
09. ERC was informed by the applicant that the Corps has requested a brief summary
letter as to the potential presence of wetlands/waters within the ravine bottom through the
PERMIT BOUNDARY as depicted in FIGURE 1 and 2. Based on this information ERC
provides the following Summary of Findings in place of a formal wetland delineation
report.
ERC was requested by the applicant to investigate for the potential presence of wetlands
and/or Waters of the US that may exist within the proposed 15-acre mine PERMIT
BOUNDARY associated with the project and specifically within the bottom of the ravine
that slopes from east to west through the PERMIT BOUNDARY. The PERMIT
BOUNDARY defines a 15-acre square parcel of land situated approximately 2,200' east of
the 10-22-09 ERC identified wetland area and proposed road crossing. The west PERMIT
BOUNDARY is located 225' east of the PROPERTY LINE. Refer to FIGURE 1 and 2.
ERC conducted a site investigation on 114-09 in the general vicinity of the PERMIT
BOUNDARY. The ground surface was clear of snow and unfrozen allowing for direct
observation of general conditions, soils and dormant vegetation. The PROPERTY LINE
was clearly identified in the field by a fence line and the limits of the PERMIT
BOUNDARY corners had been staked. The site visit was intended to identify the
presence/absence of wetlands and or Waters of the US as defined by the Corps within
PERMIT BOUNDARY.
