III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> Availability of Records <br /> Records were checked in the mine office on 7/17/09, and found to be complete and up to date <br /> through the 1 St quarter 2009. 2nd quarter monitoring records had not yet been filed. <br /> Hydrologic Balance <br /> Sedimentation ponds were inspected on the morning of July 17. The two pond system in the <br /> Pond 12 drainage was functioning effectively; Pond 012A contained only a shallow puddle and <br /> was not discharging. Pond 012, the lower pond which is the CDPS discharge point on the <br /> drainage was discharging clear flow, most of which appeared to originate from the spoil spring <br /> discharge a short distance downstream of the Pond 012A embankment. Both pond embankments <br /> appeared stable. <br /> Sediment Pond 013 contained a pool of water, level approximately 8"below the top of the <br /> primary riser; no discharge. The pond embankment appeared stable. Patches of Canada thistle <br /> are present in the immediate pond vicinity, and large patches were evident on the south facing <br /> reclaimed highwall slope to the north of the lower section of Channel YPM-4. <br /> Sediment Pond 014 contained a pool of water, level approximately 18"below top of riser; no <br /> discharge. The pond embankment appeared stable. <br /> Sediment Pond 010 was discharging clear flow through the dewatering orifice; embankment <br /> appeared stable. <br /> Sediment Pond 011 water level was one foot below the primary spillway invert; no discharge; <br /> embankment appeared stable. Small patches of Canada thistle and Dalmation toadflax were <br /> noted on the pond embankment. <br /> Numerous drainage channels that were included in the SL-2 application were walked and <br /> observations are described under the Backfilling and Grading section of this report. Channel <br /> YPM-24, which extends from the lower end of YPM-8 down along"Bear Bait Draw" to the <br /> confluence with Annand Draw was also walked, although it was not included in the SL-2 <br /> application. This is a natural drainage downstream of the reclaimed areas in the YPM-8 <br /> watershed, which had eroded in recent years. SCC graded and installed TRM liner along the <br /> channel in 2008. Heavy runoff in the spring of 2009 necessitated some maintenance along the <br /> 15 <br />
