III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> were performed in the fall of 2007, with some additional slope scarification and seeding in the <br /> fall of 2008. <br /> Photo No. 7, of the Division's 8/24/06 inspection for SL-1 bond release, is an aerial view of the <br /> East Wadge Area as it appeared on August 22, 2006, prior to implementation of TR-41 designs <br /> and associated remedial work. Photo HBR0038 attached to this (SL-4) report is an aerial view of <br /> the site taken after TR-41 designs were implemented, on 10/28/08. Various points of reference <br /> are identified on the photo; perspective view is to the northwest. <br /> Problems noted in Division inspection reports prior to TR-41 implementation included hillslope <br /> and permanent channel erosion along Channel PM-8, PM-8 tributaries, and adjacent slopes as <br /> referenced previously(see August 2006 through October 2007 inspection reports). A small <br /> slump occurred in early spring 2008 near the permit disturbance perimeter north of Pond 008, <br /> east of the PM-8 channel (see inspection reports of May and October 2008 documenting the <br /> slump and its subsequent repair). A remnant"corridor" of concentrated rill erosion was noted on <br /> the reclaimed hillslope between V-Ditch 3 and V-Ditch 4 on a 10/15/08 site inspection; repair by <br /> slope roughening and seeding was noted in an aerial inspection of 10/28/08. A site inspection of <br /> 5/26/09 noted that the V-Ditches appeared to have been largely successful in controlling erosion, <br /> and previously repaired areas had remained stable. The same report noted a few short segments <br /> of minor erosion on hillslope areas, with hand repair maintenance recommended, and also noted <br /> concerns with sidecutting erosion along a segment of Channel PM-8 and downcutting at one <br /> location where a V-Ditch entered the PM-8 channel. <br /> The SL-4 inspection of the East Wadge Area was begun by driving along a two-track route from <br /> the intersection of permanent roads "C" and "F", to a location up-slope of V-Ditch#1, above and <br /> southwest of the CSU shrub establishment test plots. The portion of the East Wadge area up- <br /> slope from V-Ditch#1 is characterized by an excellent cover of perennial vegetation, with no <br /> indications of excessive erosion or instability. The reclaimed slopes down-gradient from this <br /> starting point(generally to the south)had been the focus of previous erosional stability concerns, <br /> as well as drainage re-construction and associated remedial grading, roughening, and seeding. <br /> From the starting point, participants walked down the reclaimed slope, in a zig-zag meandering <br /> pattern, following along the length of each of the V-Ditches as well as the length of Channel PM- <br /> 8 within the release request parcel. <br /> Slope measurements were made using an inclinometer along various segments of Channel PM-8 <br /> and each of the tributary V-Ditches.
