L. o <br /> C n <br /> III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> A series of five erosion control ditches ("V Ditches 1 through 5"), run from southwest to <br /> northeast across the East Wadge slopes, and feed into PM-8. Downstream from the East Wadge <br /> Area, PM-8 drains into Sediment Pond/Permanent Impoundment 008. <br /> The East Wadge Area was included by SCC in the SL-1 application in 2006,but the area was <br /> excluded from the Division's SL-1 approval, due to extensive hillslope and channel erosion in <br /> the PM-8 watershed. The following excerpt is from the Division's 12/27/06 Proposed Decision <br /> document for SL-I: <br /> Based on the observations made during this inspection it is apparent that the <br /> design is no longer functional. The East Wadge Pit area beginning above the <br /> shrub plot study area all the way down to the South Road will need to be <br /> reevaluated to provide stable slopes and effective post-mine drainage control. <br /> One problem that has been noted in the past is that the temporary diversions <br /> constructed to divert water away for the shrub plot have concentrated the flow of <br /> water elsewhere resulting in significant gully formation. SCC will need to <br /> reevaluate the surface water runoff control plan for the entire location described <br /> above. This area will require reconstruction grading. If major disturbance of the <br /> area is caused by the regrading work, SCC should consider reseeding the area. <br /> SCC was notified during the Phase I bond release inspection that the East Wadge <br /> Pit area is not functional or stable, and therefore not eligible for Phase I bond <br /> release. <br /> The PM-8 drainage designs for the East Wadge area excluded from the SL-1 approval were <br /> revised within Technical Revision No. 41 (TR-41), approved by the Division on June 11, 2007. <br /> The TR-41 designs included modifications to the PM-8 channel design and extension of the <br /> channel further up-slope, including a segment lined with turf reinforcement mat(TRM). The <br /> plan specified elimination of certain erosive tributary channels, and addition of a series of five <br /> erosion control "V-Ditches", to be constructed at relatively shallow grades across the hillslope <br /> west of the PM-8 channel. The V-Ditches were designated V-Ditch#1 through V-Ditch#5, with <br /> V-Ditch#1 located high on the slope, and tying into the upper end of PM-8. Ditches V-2 <br /> through V-5 were spaced along the slope below V-1, with V-5 located a short distance up-slope <br /> from the endpoint of the South Road. All of the V ditches were designed to drain into Channel <br /> PM-8. Extensive rill and gully repairs and channel construction to implement the TR-41 designs <br /> 3 <br />
