Release Findings (April 25, 2003) apparently includes these two sections of roads on pagel5 <br /> under the statement "All other roads that were part of the Southfield Mine were removed <br /> during reclamation." The Division's findings are in disagreement with the on-the-ground <br /> condition of the road to the North Dewatering well and waterline. <br /> a <br /> Another portion of road exists to the substation #2 on the west side of the disturbed area. <br /> This road remains and the substation owned by Energy Fuels remains on the site. The <br /> existence of this road also is contrary to the statement in the bond release findings "All other <br /> roads that were part of the Southfield Mine were removed during reclamation." <br /> The road to the South Fan and the road to Newlin Creek topsoil pile are approved as <br /> permanent on page 2.05.3-41 and are discussed on pages 14 and 15 of the Division's Phase <br /> I Bond Release Findings (April 25, 2003) as permanent roads. The bond release findings <br /> agree with the approved reclamation plan for these two roads. <br /> The haul road from County Road 92 to the RDA is approved as a permanent road on page <br /> 2.04.3-41 and discussed in the Division's Phase I Bond Release Findings (April 25, 2003) <br /> beginning on page 14. The findings text discussion refers to a "spur off of the main haul road <br /> at the base of the refuse pile that becomes a light use road. This light use road travels along <br /> the east side of the refuse pile to the pond 3 area then turns west and travels along the north <br /> side of the refuse pile, past Pond 4, to a gate at the northwest corner of the refuse pile. The <br /> landowners have requested that these roads be left as permanent to support the post-mining <br /> land use of wildlife habitat and rangeland." Permit page 2.05.3-40 identifies the road to Pond <br /> 4 but page 2.05.3-41 does not approve this road to remain as a permanent road. The bond <br /> release findings conflict with the reclamation plan for the section or spur of road to Pond 4. <br /> The road to the parking area is identified on page 2.05.3-40. The parking area was <br /> apparently an area requested to park one vehicle next to the old coal lab building. The coal <br /> lab building was subsequently removed from the Vento property by request. While the <br /> parking area is much larger than what would be necessary for one vehicle, it is not clear <br /> whether the parking. area itself is to remain as permanent. The Division's Phase I Bond <br /> Release Findings (April 25, 2003) discuss this portion of road as a "small light-use road off of <br /> County Road 92 by the truck tunnel that travels west-southwest for approximately 500 feet. <br /> This road is used to access the coal lab building that has been approved as a permanent <br /> structure. The road spur has also been permitted as permanent with the approval of Minor <br /> Revision No. 46—approved on October 1, 2002." Field conditions indicate this road is about <br /> 5 <br />
