a. Copies of the permits for the Rocky Flats mine are <br />attached. They include the Concrete Batch Plant Air <br />Pollution Permit, the gravel mine Air Pollution Permit, <br />a copy of the Stormwater Management Plan (SGMP) a copy <br />of the Jefferson County approval for the mine and con- <br />crete plant and the raw water agreement covering water <br />used at the mine. The mine Air Pollution Permit covers <br />the Church and Rocky Flats pits. I have also attached a <br />revised Exhibit N - Other Permits and Licenses listing <br />the permitting requirements for the mine. <br />2. The wash plant is not in the Rocky Flats Pit. The water used <br />at the mine is not ground water. A copy of the water purchase <br />agreement between Bestway Concrete and Smart Reservoir & Irri- <br />gations Company showing the water being used by the mine is <br />purchased for that use. <br />3. Mr. Jeff Deathridge at the office of the State Engineer was <br />contacted regarding the stormwater that has collected in the <br />bottom of the mine. Since this could be considered ground wa- <br />ter, he advised we work to keep it from accumulating for more <br />than 72 hours. If this presented a problem, he advised we <br />contact the local water commissioner for direction on how this <br />problem should be handled. Jeff agreed that we could pump the <br />water out and spray on undisturbed areas to facilitate evapo- <br />ration or infiltration. <br />Steve O'Brian contacted the Colorado Department of Health in <br />the 1990's when the same issue was raised on the Church Pit. <br />They told him that the water could not be discharged from the <br />mine without a permit. A permit could not be issued because <br />the Total Suspended Soils in the water could not be removed so <br />the water met water quality standards. They said a sprinkler <br />system could be used to spray the water on the surface and let <br />it soak into the ground. We installed a pump and sprinkler <br />system north of the excavated area and began pumping on July <br />16, 2009. <br />4. Enclosed a revised Mining Plan Map showing the location of the <br />Concrete Batch Plant. This map is of the Rocky Flats pit so <br />does not include the wash plant and the fresh water storage <br />pond (your sedimentation pond). The location of the roads and <br />ditches are accurately depicted on this map as they were on <br />the 2009 Annual Report Map. We believe that you were confused <br />when on the site, in that you thought the processing area was <br />on the Rocky Flats Pit while in reality it is on the Church <br />Pit. Attached is an air photo showing the permit boundaries <br />for the three M.L.R.B. permits that cover the areas of distur- <br />bance. This should help you to better understand the rela- <br />tionship of the processing site and the Batch Plant. <br />MWrT.TTS TAN <br />2
