Box 596 <br />Fort Morgan, CO 80701 <br />registered or certified mail and return receipt firm or corporation who violates the <br />requested. provisions of this section shall, upon the <br />conviction thereof, be fined in accordance <br />4-625 Violations with Chapter 6 of these Regulations. <br />Failure of any person to carry out the work <br />required to be done by any such notice within <br />the time specified by the notice shall <br />constitute a misdemeanor, and any person, <br />It is unlawful for any person to discard or <br />abandon any of the waste material mentioned <br />in Sections 4-565 and 4-575 upon premises <br />not owned or occupied by the person without <br />the consent of the owner thereof, and the <br />waste material so deposited without consent <br />shall be deemed to have been discarded and <br />abandoned if it remains upon the premises for <br />a period exceeding ten (10) days.. Discarding <br />and abandonment of any waste material shall <br />be deemed to be permission by the owner <br />thereof to the County to remove and dispose <br />of the waste material as provided by law for <br />discarded, abandoned and unclaimed property, <br />and the County and its officers and agents <br />may summarily remove the waste material and <br />dispose of the waste material. <br />4-635 County Abatement <br />In event of failure of any owner of said lot(s), <br />parcel(s) and tract(s) of real property to <br />dispose of garbage, junk, abandoned vehicles, <br />farm and heavy equipment of any kind or to <br />remove abandoned structures or weeds, brush <br />or rubbish as set forth herein, at any time and <br />in any manner prescribed herein, the proper <br />officials of the County are given power and <br />authority to notify said owner 4t if said <br />owner fails to comply with these , . `gulations <br />on or before thirty (30) days from the date of <br />said notice that the proper officials of the <br />County shall forthwith remove or cut any such <br />junk, rubbish, abandoned vehicles, structures, <br />weeds or brush and the entire cost thereof, <br />4-630 Depositing Junk or Waste on Another's <br />Property <br />plus five percent (5%) for inspection and <br />expense will. be assessed against said lot(s), <br />parcel(s), and tract(s) of real property as are in <br />violation of these Regulations. The proper <br />officials of the County, after such removal, <br />shall forthwith file with the County Clerk a <br />statement showing the amount to be assessed <br />against any such lot(s), parcel(s) and tract(s) <br />of real property in payment of said inspection, <br />removal and related expense. <br />4-640 Notice of Assessment <br />The County Clerk shall send by registered <br />mail a notice to the owner of any such lot(s), <br />parcel(s) and tract(s) of real property that <br />assessment has been made against the lot(s), <br />parcel(s) and tract(s), for the cost of <br />inspection, removal and related expense for <br />failure to comply with these Regulations. <br />Any such owner may file objections to such <br />assessments within ten (10) days from the date <br />said notice is received; said objections shall be <br />filed with the County Clerk. The County <br />Clerk shall cause such objections to be <br />presented to the Board of County <br />Commissioners for review at their next regular <br />meeting following the date said objections are <br />filed with the Clerk. The Planning Ad- <br />ministrator shall issue notice to said owner of <br />the date of said review hearing by certified <br />mail. Failure of said owner to file objections <br />shall result in said assessments to become a <br />permanent lien on said lot(s), parcel(s) and <br />tract(s) of real property.
