-2- <br />behind the highwall will be backfilled. <br />• Under the heading "Typical Sequence of Operations" it is stated that "the total volume of <br />stockpiled topsoil is approximately 49,000 cubic yards." The conditions observed during the <br />preoperational inspection appeared to have less topsoil than 49,000 cubic yards. Please clarify <br />the actual amount of topsoil and overburden located at the site. <br />• Per Rule 3.1.9, where it is necessary to remove overburden in order to mine the construction <br />material, topsoil shall be removed and segregated from other spoil. Please clarify what methods <br />will be used to segregate the topsoil from the overburden and where the topsoil and overburden <br />will be stored until it is used for reclamation. Also what methods will be used to stabilize the <br />topsoil while it is stockpiled. <br />• Under the heading "Typical Sequence of Operations", part (3) states that "pumps will discharge <br />the groundwater into a settlement pond that will be located near the southwest corner of each of <br />the respective mining areas. Please revise the mine plan map to clearly identify the location of <br />the settling ponds and what the settling pond configuration will be. <br />• The mine plan also mentions a drainage swale that will be installed along the west boundary <br />line. Please locate the proposed swales on the revised mine plan map. <br />• Please clarify the proposed maximum amount of disturbance at any one time. The statement <br />provided in the mine plan does not give enough information to accurately calculate a <br />reclamation bond estimate. <br />• Please describe what measures will be taken to prevent oxidation of the Mancos Shale that lies <br />immediately under the deposit of interest. <br />3. EXHIBIT E - Reclamation Plan (Rule 6.4.5): Please provide clarification for the following items: <br />Throughout the application the proposed post mine land use is inconsistent. Please clarify what <br />the intended post mine land use is and submit corrections to the application for the <br />inconsistencies noted in the application. <br />Section Part 2(c) 3.1.3 states that "final reclamation for the 32.5 acre area is anticipated to <br />require 6 months to complete." 32.5 acres is more acreage than the 30.25 acres stated on page 1 <br />of the application form. Please clarify what the total acreage is. Clarify what the affected and <br />total permit acreages are for the proposed operation. If more than 30.25 acres is required an <br />amendment to the application will be required to incorporate any new acreage into the <br />application. <br />• Section Part 2(c) 3.1.6 states that a settlement pond will be located near the northwest corner of <br />the project site. All other parts of the application state the dewatering ponds with be located in <br />the southwest corner of each phase. Please clarify exactly where the ponds will be located and <br />locate them on the mine plan map. <br />• Section part 2 (c) 3.1.9 states that 2-6 inches of topsoil will be removed and stockpiled. This <br />amount is inconsistent with the figures stated in the mine plan which states that 6-12 inches of <br />topsoil will be salvaged and stockpiled. Please clarify what amount of topsoil is the correct
