The findings of Planning Stan, as set forth above. are adopted as the findings of the Board. <br />B. The Board further finds: <br />1. That the development proposed by the Applicant is a reasonable use of Its <br />property and upon compliance with the condition listed below will be <br />compatible with the use and occupancy of the neighborhood. <br />2. That the anticipated impacts of Die development can be mitigated by <br />compliance with the performance standards of the regulations and the <br />conditions set forth below. <br />C. All outside lighting shall be hooded. <br />2. A detailed site plan approved by the Applicant and County Planner shag be attached <br />to the Development Agreement and recorded in the office of the Della County Clerk <br />and Recorder. <br />3. A weed mitigation plan shalt be submitted and approved by the Delta County Weed <br />Coordinator. <br />4. The applicant shall provide 100 hours of operation of his D-8 Dozer m reconstruct <br />the ImoB Hill on F Road with Delta County providing the fuel for the dozer. <br />Construction of the Improvements shall be under cite direction of the District #1 Road <br />Foreman. In the event the F Road Improvements do not use the fug 100 hours, the <br />applicant shall provide such services anywhere in the (county at the County's <br />discretion. <br />8. Portable self-contained toilets meeting the Delta County Individual Sewage Disposal <br />System regulations shag be maintained on site for employees should the operator <br />hire employees at the eke. <br />6. Ratan sates will be allowed at the mine location. <br />7. Copies of all permits issued by the Division of Water Resources, the Division of <br />Minerals and Geology, the Colorado Department of Health and Environment, and the <br />Mine Safety and Health Administration shall be provided to Delta County prior to <br />Commencing, or during the course of, operations. Applicant shall comply with the <br />conditions of all of the permits Issued by the State, Including but not limited to the <br />reclamation plan approved by the State Division of Minerals and Gtloiogy. <br />8. The applicant shall ensure that any irrigation ditches that run through or adjoin the <br />operation shall either be relocated and7or makitsined so that Cure is no interruption <br />of Irrigation water to users of that water. <br />Moonscape Pit, July 2009 M-4
