07/15/2009 23:03 9708746851 KELLMEABER <br />RECIPTTONN: 636134, 07/13/2009 at u3:ly:UY awe, 1 va 4, ?ai ~,0260 P. 003/007 <br />COUNTY, CO CLFM AND RHCORDER <br />RESOLUTION <br />OF THE <br />BOARD OF COUNTY COMMISSIONERS <br />OF THE <br />COUNTY OF DELTA, STATE OF COLORADO <br />RESOLUTION NO.20WR-0 Sy <br />RESOLUTION TO CONDITIONALLY APPROVE SD09 S BOTH GRAVEL PIT EXPANSION <br />ANDREW BOTTI, APPLICANT <br />KELLY YEAGER, REPRESENTATIVE <br />WHEREAS, pursuant to Resolution 2007-RMI (Specific Development Regulations), <br />Andrew Botti, applicant, filed a Specific Development application for WsVareron of an existing gravel <br />pit located in the NW N of Section 27 & NE 'A of Section 28. Township 15 South, Range 95 West <br />of the 6a Principal Meridian in Delta County, Colorado. The expansion area is anikdpated to be 14 <br />awes for a total of 21.65 acres of mined land on property owned by Andrew Bottl west of Delta near <br />the intersection of F Road and Sundown Road. *nd <br />WHEREAS, the Planning Department notified all surrounding property owners within one <br />halt mile of the subject property and approprfatq review agencies by mall, a sign was posted at the <br />gravel pit location. and a public notice was published in the Deft Cowry Independent at least <br />seventeen days prior to the scheduled Planning Commission Meeting. The Delta Advisory <br />Committee met on June 23, 2009 and recommended the application be forwarded to the Planning <br />Commission. The Planning Commission met on June 25, 2009, and recommended approval of the <br />application: and <br />WHEREAS, this Board condoled a hearing on June 29. 2009. at which time the Board received <br />staff recommendations from the Planning Departmem, and heard testimony of the Applicant and <br />the applicants representative. The Board has considered all of these matters in reaching its <br />Conduslon , and <br />WHEREAS, Planning Staff has reviewed the Specific Development application for <br />completeness. Based on that nnriew, the application appear; to meet the Imera of the Delta County <br />Specfic Development Regulations and Staff finds that <br />1. The application Is for industrial use of a parcel as defined in Article It Section 4 of the <br />Specific Development Regulations. <br />2. The property is located now the intersection of F Road and Sundown Road west of Delta. <br />3. Current use of the parcel is a gravel pit which has been in operation for the last 12 years <br />with some agricultural land and a confined chicken operation adjacent to the parcel. <br />4. The applicant has agreed to work with the District en Road & Bridge Foremen to make <br />improvements to F Road near the operation. <br />5. Use of the properly at the conclusion of gravel pit operations well be a residential <br />subdivision. <br />NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Delta <br />County as follows: <br />Moonscape Pit, July 2009 M-3
