Applicant shalt be <br />aull)NIzed to perform regular maintenance during reasonable hours on Sundays and <br />holidays, so long as no mining or crushing operations take place and. if necessary <br />due to weather condltions, Applicant shall be authorized to "warm up' Its equipment <br />up to one half (112) hour in advance of the commencement time set forth above for <br />operations. <br />10. Applicant shag comply with an aggressive plan of rapid land reclamation to reduce <br />the actual mined area and to limit the area to be disturbed for mining. <br />Not" Mitigation <br />11. (a) To the extent applicable, and except as set forth herein. § 25.12-103, C.R.S. <br />(Maximum Permissible Noise Levels), shall be and hereby Is Incorporated herein as <br />set forth In its entirety. This development shall be conducted in a manner so that any <br />noise produced is not objectionable due to intermittence, beat frequency or <br />shrillness. The commercial classification of the statutory noise standards is most <br />appropriate for this area, the sound levels of noise radiating from the property Onto, <br />attributable to Applicants mining andlor crushing operations, wherein the <br />development is located at a distance of twenty-five (25) feet or more therefrom In <br />exoess of the db(A) set forth below for the following time periods shall constitute <br />prima facie evidence that such noise Is a public nuisance. <br />(1) 7:00 am. to the next 7:00 p.m., Monday through Friday: 60 db(A) <br />(2) 7:01) p.m, to the next 7:00 a.m., Monday awugh Friday and at all <br />times on weekends; 55 db(A) <br />(3) In the hours between 7:00 a.m. and the next 7:00 pm.. the noise <br />levels penntited herein may be increased by ten (10) db(A) for a <br />period not to exceed fifteen (15) minutes in any one-hour period. <br />(b) At any point 200 feet beyond the Applicant's property tine, the noise level shall <br />not exceed 55 db as provided for in Colorado Revised Statutes for Residential Areas. <br />(See § 2572-10%.C.R.S.) In the hours between 7:00 am. and the next 7:00 p.m.. <br />the noise levels permitted herein may be increased by ten (10) db(A) for a period not <br />to exceed O teen minutes in any one-hour period. M this standard cannot be met, <br />then the development will not be authorized to proceed, <br />12. Noise reducing measures should include at least the following: <br />(a) The generator providing power to the crusher Shall be housed in an insulated <br />modular or mobile structure, shall incorporate the use of a residential or a large <br />industrial muf%r, for purposes of sound mitigation, and shall be placed in such a <br />direction to minimize noise emanating from the mine site, <br />(b) All other equipment powered by internal combustion engines operating on the <br />site shall be equipped with functional industrial mufflers. <br />(c) Applicant shall use existing barriers, shall construct a berm, or shall create and <br />maintain stockpiles to the extent necessary to preclude to the greatest extent <br />possible the movement of sound towards residences in the area. <br />(d) Rubberized material will be used to line dump points on"crusher. <br />Moonscape Pit, July 2009 M-5
