As required by Rule 1.6.2(1)(e), please submit proof of public notice circulated to all owners of record of <br />surface lands, mineral rights and easement holders that are on the affected land and within 200 feet of <br />the boundary of the affected land. Proof of notice may be return receipts of a Certified Mailing or by <br />proof of personal service. <br />On June 18, 2009, the Division received proof of notice to Yampa Valley Electric Association and Xcel Energy <br />by Certified Mail Receipt. Please submit the return receipts for these notices to the Division along with proof <br />of notice to all owners of record of surface lands and mineral rights within 200 feet of the boundary of the <br />affected land. <br />4. The Division received comments from the Colorado Historical Society, Colorado Division of Water <br />Resources and Routt County Conservation District. The letters are attached for your review. Please <br />address the comments noted in the letters and make any changes in the application as necessary. <br />5. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, or other <br />qualified person. Chris Rundall with Baseline Engineering Corporation did not sign the maps submitted <br />to the Division on May 20, 2009. Please resubmit signed copies of the maps to the Division. <br />Rule 6.4.3 Exhibit C - Pre-Mining and Mining Plan Maps <br />6. Rule 6.4.3(a) states the applicant is required to depict all adjacent surface owners of record. Please <br />indicate all adjacent surface owners of record on Exhibit C - Pre-Mining Plan Map. <br />7. Rule 6.4.3(e) states the applicant is required to depict the type of present vegetation covering the affected <br />lands. Please depict the type of present vegetation covering the affected lands on Exhibit C - Pre-Mining <br />Plan Map. <br />The Mine Plan Map dated May 14, 2009, indicates a minimum 50' buffer between the Yampa River and <br />the mine boundary. The applicant agreed to a buffer of 200 to 250 feet from the Yampa River during <br />the original permit adequacy review. Please reference Item #5 in the Division's Rationale for <br />Recommendation of Approval dated July 13, 2001. Please commit to maintaining a 250 foot offset from <br />the Yampa River and revise Exhibit C - Pre-Mining Plan Map. <br />Rule 6.4.4 Exhibit D - Mine Plan <br />Per Rule 1.10.1 (1), the applicant will not be required to submit any information, which duplicates applicable <br />previous submittals. However, the Applicant shall clearly describe where in the original application and <br />supporting documents, the information not included in the amendment application, but necessary to render the <br />amendment technically adequate may be found. <br />9. The Applicant directs the Division to "see existing permit" regarding Exhibit D - Mining Plan. Mining <br />activities in the amendment area will alter the current mining plan by postponing the current phases. <br />Please describe how the amended mining phasing will affect the current mining plan. <br />10. Please provide a description of the "slot" mining method proposed during the pre-operational <br />inspection and how the method will protect the cottonwood trees it is intended to protect.
