Cattany <br />Division Director <br />Natural Resource Trustee <br />Dear Mr. Zehner, <br />The Division has reviewed the content of Precision Excavating, Inc. 112c permit amendment application for the <br />Camilletti Milner Pit #2, File No. M-2001-023, and submits the following comments. The Division of <br />Reclamation, Mining and Safety (Division) is required to make an approval or denial decision no later than <br />August 14, 2009, therefore, your response to the following adequacy review concerns should be submitted to <br />the Division as soon as possible. <br />1. The Division requires the company name listed throughout the application form (including within the <br />notarization) match the company name listed on the current permit and with the Colorado Secretary of <br />State. <br />The amendment application was submitted as Camilletti and Sons, Inc. as the applicant/operator. On August <br />24, 2001, the Division approved the Transfer of Mineral Reclamation Permit and Succession of Operators <br />application to transfer the Camilletti Milner Pit #2 permit from Camilletti and Sons, Inc. to Precision Excavating, <br />Inc. Please submit a revised permit amendment application to the Division with Precision Excavating, Inc. as <br />the applicant. <br />On June 5, 2009, the Division received a revised application form indicating "Precision Excavating, Inc." as the <br />applicant. This item has been resolved. <br />2. The Division sent an Adequacy Review letter dated May 29, 2001 regarding the original permit <br />application. A copy of the Applicants adequacy response is not on file with the Division. Please submit <br />the response to the original application adequacy review. The Applicant directs the Division to "see <br />existing permit" for several Exhibits, however without a full understanding for the existing permit the <br />Division is not able to evaluate the amendment application for adequacy. <br />On June 3, 2009, the applicant provided a copy of the Division's "Rationale for Recommendation of <br />Approval", "Pre-Hearing Conference Order" and a statement that the adequacy issues were discussed a <br />resolved at the June 5, 2001 informal conference.
