When determining the amount of bond to be released, the Board or Division shall retain that amount <br /> of bond for the revegetated area which would be sufficient for a third party to cover the cost of <br /> reestablishing revegetation at any time during the period specified for permittee responsibility for <br /> revegetation described in 3.02.3 [Rule 3.03.1(3)(a)J. <br /> Bond for Remaining Reclamation Work <br /> The Division shall not release any amount under performance bonds applicable to a permit if such <br /> release would reduce the total remaining amount under performance bonds to an amount less than <br /> that necessary for the Division to complete the approved reclamation plan [Rule 3.03.1(3)(d)J. <br /> Minimum Bond <br /> in no case shall the total bond amount applicable to a permit area be less than $10,000, in <br /> accordance with 3.02.2(3), until bond for the entire permit area is fully released[extract from Rule <br /> 3.03.1(4)]. <br /> III. Observations And Findings <br /> The Division made a review of permit documentation on file at the Division, and conducted an on- <br /> site inspection on June 20, 2001. Results of inspections and monitoring conducted pursuant to Rules <br /> 4.05.13 and 5.02 were considered. No inspection results were found that would inhibit this bond <br /> release. The application was expanded for partial Phase I Bond release as well (April 2, 2001). The <br /> purpose of the inspection is to evaluate [Rule 3.03.2(2)] that reclamation operations alleged to have <br /> been completed had been completed, the degree of difficulty to complete remaining reclamation, <br /> pollution of surface or subsurface water, and the probability of future occurrence of such pollution. <br /> Phase I <br /> The two monitoring wells were OW-1 and OW-15 at the Lacy Loadout. The Lacy Loadout was <br /> removed from the permit by Technical Revision 14 (December 18, 1996) because it was never <br /> constructed (PAP page 4-26). <br /> Culvert 3 was reported as having been removed in 1995 (PAP Page 4-57). A Division inspection of <br /> October 15, 1999 found that Culvert 3 had been removed. Culverts 2 and 6 are permanent culverts. <br /> Culvert 5 is integral to the sedimentation pond. <br /> The pile of waste rocks is an item discussed in the PAP on page 4-59 (08-04-95). A number of large <br /> rocks were placed along the eastern toe of the lower terrace. They were to be buried. NCIG reported <br /> that the rocks had been buried. The rocks were found to have been buried during the Division Phase I <br /> and Phase Il Bond Release Inspection (Inspection) of June 20, 2001. <br /> SL-02, C-84-065 <br /> August 17, 2001 <br /> Page 8 of 13 Pages <br />
