The Division <br /> approved (October 19, 1995) a partial Phase I Bond release (SL-01) of$161,994. This Application <br /> (SL-02) includes the reclamation of Phase I work that was not released in the SL-01. This work <br /> includes 1)removal of two groundwater monitoring wells, 2) removal of a culvert (C-3) [Division <br /> letter of May 26, 1995, Re: Phase I Bond Release Decision Coal Ridge No. 1 Mine (C-84-065)], 3) <br /> disposal of a pile of waste rock, 4) backfilling of a cutslope, 5) distribution of a topsoil stockpile, 6) <br /> repair of a slump over one of the portals, and 7) stabilization of terrace outslopes which exhibited a <br /> slump at the time of the Phase I bond release inspection. <br /> Phase II <br /> Up to eighty-five percent of the applicable bond amount shall be released upon the establishment of <br /> vegetation that supports the approved postmining land use and which meets an approved success <br /> standard for cover. However, no more than sixty(60)percent of the bond shall be released so long as <br /> the lands to which the release would be applicable are contributing suspended solids to streamflow or <br /> runoff outside the permit area in excess of premising levels as determined by baseline data or in <br /> excess of levels determined on adjacent nonmined areas; or until the essential hydrologic functions <br /> and agricultural productivity have been reestablished on alluvial valley floors[Rule 3.03.1(2)(b)J. <br /> Replacement of Topsoil <br /> Replacement of topsoil may be considered an element of either Phase I or Phase H work.A thickness <br /> of 10 inches was required (PAP page 4-53). However, 16 inches of topsoil was cited as the required <br /> depth in a proposed decision on the Phase I Bond Release Application. <br /> Vegetation that Supports the Postmining Land Use <br /> The postmining land use is agricultural (PAP page 4-63). This use is identified as cropland, <br /> pasture/wildlife habitat and rangeland/wildlife habitat on page 4-53 of the PAP, and as cropland <br /> (irrigated) and pasture/wildlife habitat on Figure 4.7-2 Future Land Use. The two uses of this findings <br /> are irrigated cropland and dryland pasture/wildlife habitat. <br /> Vegetation Success Standard for Cover <br /> The vegetation success standard for cover of the dryland pasture/wildlife habitat is 90% of the <br /> reference area cover (PAP page 4-62).
