NCIG had reported that the backfilling of a cutslope had been accomplished. The backfilling of a <br /> cutslope was found completed during the Inspection. <br /> Material in the two remaining topsoil storage piles is to be used in reclamation of the sedimentation <br /> pond. They have been vegetated for protection, and have been properly marked. The reclamation of <br /> these two piles is considered integral to the reclamation of the sedimentation pond. These topsoil <br /> piles and the footprint of the piles are not to be released in this partial Phase I application, but will be <br /> considered for release after they have been reclaimed under the provisions of Rule 3.03.1(5). <br /> The stabilization of terrace outslopes which exhibited a slump at the time of the SL-01 inspection <br /> were reported complete by NCIG. Stabilization of terrace outslopes was found complete during the <br /> Inspection. <br /> The Division finds that all Phase I work applicable to the Application complete. <br /> Phase Il <br /> Replacement of Topsoil <br /> The placement of 20 inches of topsoil over backfilled areas (approximately 25 acres) was reported in <br /> the NCIG Inc. 1994 Annual Reclamation Report. The Division verified topsoil replacement thickness <br /> during a partial inspection on August 30, 1995. Based on the August 30, 1995 topsoil sampling, all <br /> areas except one measurement at Portal No. 2 met the required 16-inch topsoil replacement thickness. <br /> NCIG subsequently reported placement of additional topsoil.A depth of topsoil at this location was <br /> found to be at least 16 inches during the Inspection. <br /> Vegetation in the Supports of the Approved Postmining Land Use <br /> Diversity is not a requirement for Phase H Bond Release. However, the Division evaluates the <br /> vegetation data and determines if the site is approaching the requirements for successful diversity. <br /> The diversity standard on the dryland pasture/wildlife area requires four (4) perennial species with at <br /> least three(3) cool-season grasses. Each species contributing to the diversity standard will contribute <br /> greater than three (3) percent relative cover,but no more than sixty (60)percent relative cover. Even <br /> after grazing and drying out of the perennial forbs, the data collected in October 2000 met this <br /> criteria. Visual inspection of the site in the spring of 2001 raises the question of the relative cover of <br /> the alfalfa. Although the fall sampling in 2000 found the site met the diversity standard, future <br /> sampling must be conductesi during the growing season prior to impacts from grazing [Rule <br /> 4.4.15.5(2)]. <br /> Cropland Production <br /> The cropland seed mix consisted of Orchardgrass, Brome grass, and Timothy (Table 4.4-3a).Alfalfa <br /> SL-02, C-84-065 <br /> August 17, 2001 <br /> Page 9 of 13 Pages <br />
