U.S. DEPARTMENT OF THE INTERIOR <br />OFFICE OF SURFACE MINING RECLAMATION AND ENFORCEMENT <br />FINDING OF NO SIGNIFICANT IMPACT <br />FOR <br />Foidel Creek Mine <br />Federal Coal Leases COC-081330, COC-20900 and COC-67514 <br />Mining Plan Decision Document <br />Introduction <br />Twentymile Coal Company submitted a permit application package (PAP) for a permit <br />revision for the Foidel Creek Mine to the Colorado Division of Reclamation, Mining and <br />Safety's (CO-DRMS). The PAP proposed extending underground mining operations into <br />approximately 614 acres of new Federal lease COC-67514 and Federal leases COC- <br />081330 and COC-209000. Under the Mineral Leasing Act of 1920, the Assistant <br />Secretary, Land and Minerals Management, must approve, approve with conditions, or <br />disapprove the mining plan modification for Federal leases COC-081330, COC-20900 <br />and COC-67514. Pursuant to 30 CFR Part 746, the Office of Surface Mining <br />Reclamation and Enforcement (OSM) is recommending approval of the mining plan <br />modification action without special conditions. <br />2. Statement of Environmental Significance of the Proposed Action <br />• <br />The undersigned person has determined that the above-named proposed action would not <br />have a significant impact on the quality of the human environment under section <br />102(2)(C) of the National Environmental Policy Act of 1969 (NEPA), 42 U.S.C. <br />4332(2)(C), and therefore, an Environmental Impact Statement is not required. <br />3. Reasons <br />This finding of no significant impact is based on the attached Environmental Assessment <br />Report CO-016-91-027 dated January 1991, titled Little Snake Resource Area - Craig <br />District, Application for Federal Coal Lease Modification, Cyprus Western Coal <br />Corporation, Lease C-081330, the Environmental Assessment, CO-100-2006-075 EA, <br />COC-20900, dated July 13, 2006, and the Environmental Assessment, CO-100-204-061 <br />EA, COC-67514, dated February 25, 2005, all prepared by the Bureau of Land <br />Management, and with respect to updated information on threatened and endangered <br />species and historic preservation. These documents have been independently evaluated <br />by OSM and determined to assess the environmental impacts of the proposed action <br />adequately and accurately and to provide sufficient evidence and analysis for this finding <br />of no significant impact. <br />9. t 425? <br />• Manager, Field Operations Branch Date
