member of the Association that involves travel on the Easements by members of the public for <br />the purpose of generating business income for an owner of a home site. For example. use of a <br />home site and the Easement to operate a hunting. fishing. or outfittin; business is prohibited. <br />e. The commercial gravel operation referenced above will be for a term of <br />ten years from the date of commencement of the lease between JAK Ventures and the gravel <br />operator, which will be the date that all necessary governmental permits are issued to allow <br />gravel mining to begin. Any extension beyond ten years will require consent of the Reids or <br />their successors or assigns, in writing. Trucks or other vehicles hauling gravel past the Reid <br />home site near the northeast corner of the Lot 2, Section 33 ("Reid Residence"), shall be limited <br />to nine months per year (i.e., September through May, as in a normal school year), with no traffic <br />in June, July, or August, and during those nine months per year shall be limited to 7:00 a.m. to <br />4:30 p.m. These limitations shall not apply to vehicles or trucks hauling gravel or accessing the <br />easement for normal gravel mining operations purposes on the portions of the easements that are <br />north of the Reid Residence. The parties intend that this limitation on trucks and vehicles <br />hauling gravel past the Reid Resident shall not apply to normal employee traffic going to and <br />from a gravel mining site south of the Reid Property. <br />3. Gate. JK Ventures agrees to install a privacy gate at the northern entrances to the <br />JAK Venture Property, or in a location agreeable to the Reids. Aside from this gate, no party <br />shall install other gates, cattle guards or other obstructions on the easements without consent of <br />the other party. <br />4. Road Surface and Repair. <br />a. The road used on the easement described in La and Lb (C and D on the <br />Map) above shall be improved with asphalt pavement by JAK Ventures, at its cost, starting at <br />Highway 141 and continuing past the Reid Residence to the northern boundary line of Lot 3 in <br />Section 33. During the period of any gravel mining operations, all costs of maintenance for road <br />surface shall be paid by JAK Ventures. After the termination of the gravel mining operations, <br />the Reids' share of the maintenance costs will be on a pro rata basis, determined by the number <br />of development units using the roads, which will include all of the JAK Property and the Reid <br />Property. <br />b. Any dispute relating to the pro-rata share of the parties is to be resolved <br />according to Colorado law. <br />5. Utilities. JAK Ventures agrees to install all electric, water, sewer, and cable <br />utilities underground along the course of the easements, and will pay to extend them from their <br />current location. <br />6. Boundary Adjustments. In partial consideration for the easements and cross- <br />easements granted in this Agreement, JAK Ventures will, by separate boundary agreement, <br />convey two portions of property to the Reids to eliminate a boundary encroachment on the site of <br />the Reid Residence, and to provide the Reids with approximately six acres of land on the north <br />side of their Lot 1, Section 33, along the Colorado River. <br />
