6.4.12 EXHIBIT L - Reclamation Costs <br />28.) This section is still under review. Some information is needed in response to this adequacy <br />review to conduct the cost estimate. <br />6.4.13 EXHIBIT M - Other Permits and Licenses <br />29.) Please include a substitute water supply plan and a well permit from the Division of Water <br />Resources in the list of other permits and licenses that will need to be obtained. <br />6.4.14 EXHIBIT N - Source of Legal Right to Enter <br />30.) For the Arends parcel, a statement by the landowner entitled "Unanimous Written Consent <br />Concerning Legal Right to Enter Made by the Members of Aggregate Investments LLC and the <br />Partners of Sprat-Platte Ranch Co., LLP" was submitted as a source of legal right to enter. In <br />accordance with Rule 6.4.14 this agreement must be acknowledged by a Notary Public. <br />31.) Please submit a source of legal right to enter for the remaining parcels in the expansion <br />area. This could be a copy of the access lease, deed, abstract or title, or current tax receipt. <br />6.4.19 EXHIBITS- Permanent Man-Made Structures <br />32.) There are numerous structures on and within 200 feet of the proposed permit area as listed <br />in this exhibit. In accordance with Rule 6.4.19, when mining operations will adversely affect the <br />stability of any significant, valuable and permanent man-made structure located within 200 feet <br />of the affected area, the applicant may either: <br />a.) Provide a notarized agreement between the applicant and the person(s) having an <br />interest in the structure, that the applicant is to provide compensation for any damage <br />to the structure; or <br />b.) Where such an agreement cannot be reached, the applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall not be <br />damaged by activities occurring at the mining operation. <br />Please provide evidence (certified letter to structure owners) that a notarized agreement <br />between the structure owners and the applicant was pursued or, in lieu of reaching these <br />agreements, the engineering evaluation will be considered. <br />33.) Third Creek will be relocated during the mining and reclamation process, please provide <br />evidence that you have been granted the right to relocate this structure. This could be in the <br />form of an agreement between your company and the persons having interest in this structure. <br />Also, you will be impacting land within 200 feet of Third Creek. Please provide a notarized <br />agreement(s) between Ready Mixed Aggregates and the person(s) having interest in this <br />structure, that the applicant is to provide compensation for any damage to the structure.
