19.) For the Bromley Lakes Cell No. 2 parcel and the area east of the relocated McCanne Ditch,
please label the proposed land use for these portions of the affected area.
20.) The map is rather non-descript about the configuration of the Bromley Lakes Cell No. 2
parcel. Please depict/display the configuration and proposed land use of this parcel.
6.4.7 EXHIBIT G - Water Information
21.) How many total wells will be used to monitor ground water levels? Please display the
location of the wells on the Exhibit G Water Information map. Please state how often these
wells will be monitored (monthly, quarterly, etc..)? Also, please describe what actions will be
taken if the five foot trigger point is breached at the monitoring wells? For example, who will be
notified and how will the problem be mitigated?
22.) Please display the location of Third Creek and McCanne Ditch on the Exhibit G Water
Information Map.
23.) Please estimate the projected water requirements for the operation, including flow rates
and annual volumes for the development, mining and reclamation phases of the project.
24.) Please indicate the projected amount of water that will be used for each source if there is
more than one.
25.) The instillation of the slurry wall may have undesirable effects on the prevailing hydrologic
balance of the permit area and the surrounding areas. Please describe how you will minimize
the disturbance to the prevailing hydrologic balance of the ground water systems of the affected
land and the surrounding area in regards to mounding and shadowing issues both during and
after the mining operation and during reclamation? Please include a plan for how mounding
and shadowing issues will be monitored and how problems will be identified and mitigated.
26.) In this Exhibit, it states that there are "nominal" jurisdictional wetlands found at the site
and a Nationwide 46 permit will be obtained in order to mitigate disturbances to these
wetlands. However, in the letter dated November 5t", 2007 from the Army Corps of Engineers
included in this exhibit, it states that a permit will not be required. Please clarify this
discrepancy. If a permit is required, on the Exhibit G Water Information map and the Exhibit D
Mining Plan Map, please delineate the area that encompasses the nominal jurisdictional
wetlands found at the site. Also, please provide a copy of the Nationwide 46 permit to the
Division prior to disturbing these areas.
6.4.10 EXHIBIT J - Vegetation Information
27.) This Exhibit describes the type of vegetation that is found within the expansion area, please
include a quantitative estimate of cover and height for the principle species in each life form
represented (i.e., trees, shrubs, grasses and forbs).
4
