4. The Division requested and SCC has committed to submit a final geotechnical <br />report and remedial plan for the "Shrub Plot Slide" and "Pond 016 Slide" within <br />60 days of receipt of the final report. Item Resolved. <br />5. The Division requested a commitment to define the woody plant density standard <br />for designated aspen planting areas within or prior to the 2010 permit renewal <br />application, and SCC complied with the request, stating in their response letter <br />that "SCC is conducting monitoring and analyses to determine appropriate and <br />reasonable woody plant density standards. A revision to update Tab 22 will be <br />addressed in the next permit renewal or in advance of Phase III bond release <br />request whichever comes fast". <br />The Division also requested that SCC update Appendix 22-3, "Aspen Study <br />Plan", to incorporate status and findings of completed and on-going studies on <br />SCC reclaimed lands related to aspen and serviceberry reestablishment. SCC has <br />responded that three pertinent study reports have been completed and submitted <br />within recent Annual Reclamation Reports (January 2006, February 2007, and <br />February 2009). SCC presented rationale to support inclusion of the study reports <br />in the Annual Reclamation Reports, but not in the permit application documents. <br />We have considered SCC's responses, and largely concur. With respect to the <br />need to define a woody plant density standard for the designated aspen <br />establishment areas, we plan to assess study sites and reclamation plantings in the <br />field this summer, and will invite appropriate Division of Wildlife staff to <br />participate in field assessment, as well as the review of aspen establishment <br />standards to be proposed in the near future. <br />In regard to requested updates to Appendix 22-3 "Aspen Study Plan", we agree <br />that the study reports have been properly included in the referenced Annual <br />Reclamation reports and that it is not necessary that the reports be included in the <br />permit application. However, we believe an update to Appendix 22-3 (which was <br />written in 2004) is warranted. Under Section 9.0 "Results" of the appendix, <br />narrative indicates that SCC will make an evaluation of field trials and tests by the <br />fall of 2008. We have the following request: <br />Please provide a 2009 update to Appendix 22-3, to include reference to the <br />cited study reports and a brief summary of the findings of said reports, as <br />well as a brief summary of the status and results of the additional field trials <br />described in Appendix 22-3. <br />6. The Division made a number of requests regarding proposed permanent structures <br />that SCC had addressed in amended Tab 20 narrative, maps, and new Attachment <br />20-2. Listed below is a summary of each request and associated response, and the <br />Division's corresponding determination: <br />3
