TR-62 2nd ROUND ADEQUACY REVIEW <br />3. In the mid-term review, the Division had requested that SCC provide clarification <br />and pertinent modifications to various sections of the PAP, regarding site <br />location, monitoring site designation, and associated information regarding <br />"Friederich Springs #1 and #2. These requests were adequately addressed in the <br />initial TR-62 submittal. <br />The Division also requested that SCC address how compliance with Rule 4.05. 15 <br />Water Rights and Replacement, has been (or will be) achieved with respect to the <br />adjudicated springs that were impacted by mining ("mined out"), on the <br />Friederich property. SCC stated in their original TR-62 submittal, and reiterated <br />in their March 19, 2009 submittal, that water flowing into Pond 016, with an <br />average flow of 56 gpm, will be used to replace the Friederich springs water <br />rights. In the original submittal, SCC included amended narrative on revised page <br />11 of PAP Tab 16, stating that the amount of righted flow for the Friederich <br />springs was .066 cfs (30 gpm), to be used for livestock watering, and that "water <br />flowing into Pond 016, with an average flow of 56 gpm...will be used to replace <br />the water from these springs". Information addressing the suitability of the spoil <br />spring discharge for livestock watering was not addressed, but based on <br />discussion with SCC staff, this was an oversight and the information will be <br />provided. <br />a) Please provide amended narrative and data reference addressing water <br />quality suitability for the spoil spring flow that would be used to replace <br />the mined out adjudicated springs on the Friederich property (this <br />information is to be submitted before the Division will issue a proposed <br />decision for TR 62). <br />The issue of water rights replacement will need to be addressed in the future as a <br />part of the hydrologic evaluation for Phase III bond release. Monitoring of the <br />subject springs will need to be continued until final bond release, and the <br />monitoring data will need to be evaluated in the bond release application, in part <br />to document compliance with Rule 4.05.15. <br />b) We have prepared a letter to be sent (along with SCC's most recent TR- <br />62 responses) to the Division of Water Resources, Office of the State <br />Engineer, explaining the situation with regard to the Friederich springs <br />and requesting their input. We will forward a copy of the State Engineer <br />response to you (along with a request for revision of the permit if <br />warranted), upon receipt. Due to the time that may be required for State <br />Engineer response, we will not delay issuance of the TR-62 proposed <br />decision for this item. <br />2
