a) The Division requested that, for all proposed permanent features, SCC would <br />need to provide a description of how the features will be compatible with the <br />approved postmining land use, pursuant to Rule 2.05.5(1)(a). <br />SCC's response noted that Attachment 20-2 had been amended to highlight the <br />discussion of the compatibility of proposed permanent structures with the <br />postmining land use. Justification addressing compatibility was presented for <br />proposed permanent roads, Shop and Storage Area (shop building, <br />storage/parking area, and electric transformer), Shop Well, Powerline and <br />Substation, Fenced Shrub Plots, and Permanent Fencing. <br />Complete information required for approval of sediment ponds and stock ponds as <br />permanent impoundments has not yet been provided; however commitments to <br />provide required documentation/demonstrations are included in the Attachment <br />20-2 text. In addition, approved permit language in Tab 13 narrative (page 5), <br />commits to "submittal of a complete technical revision demonstrating that each <br />permanent impoundment meets the requirements of Rule 4.05.9(13) for <br />permanent impoundments ... prior to submittal of a bond release request...". <br />Likewise, additional documentation will need to be provided regarding retention <br />of certain roads as permanent. Appropriate commitments are included in the <br />amended Attachment 20-2 text, and the requirement for demonstration of <br />compliance prior to Phase I bond release is specified in Permit Stipulation No. 32. <br />We note one editorial error; on amended page 20-2.1, under Access Roads <br />Documentation, the first sentence is a fragment ("...consists of."). Please revise <br />the text to properly complete the sentence. <br />b) The Division requested comments from Routt County indicating their <br />knowledge of and agreement with retention of all proposed permanent facilities. <br />SCC's letter response stated that they had made request to the Routt County <br />Planning Department regarding any necessary county approvals. <br />A letter dated March 30, 2009, from the Director of the Routt County Planning <br />Department to Roy Karo of SCC, was hand delivered to the Division on April 24, <br />2009, and placed in the TR-62 public file by the Division. The letter indicated <br />that retention of remaining structures as permanent facilities to support the <br />postmining land use would not conflict with Routt County zoning regulations. <br />Item Resolved. <br />c) The Division requested certain commitments regarding retention of sediment <br />ponds and stock tanks as permanent structures, including documentation of <br />compliance with applicable state law with respect to water rights. A letter of <br />February 24, 2009, from Dr. Mark J. Vanarelli of the Division of Water <br />Resources, Office of the State Engineer (previously provided to SCC) indicates <br />that necessary water rights related documentation for permanent diversion and <br />storage of surface water within the permit area has not yet been submitted and <br />4
