6.) The maximum depth of the gravel pit will be 18 feet. The depth will vary however <br />with no areas over this depth. <br />7.) As shown on the Mining Plan Map there is a setback of 200 feet around the gas <br />well named "LARRY". No encroachment into this area will be done for any <br />reason. The other manmade structures are the gas pipeline that runs along the side <br />of the existing roads. They will not be disturbed in any way. An agreement <br />between Pioneer Natural Resources USA, Inc. and Robinson Sons, Inc. is <br />attached to this adequacy reply please reference for your review. <br />8.) This mine site will have a State of Colorado Stormwater Discharge Permit. The <br />Storm Water Management Plan (SWMP) has plans to palace earthen berms in <br />areas that will direct stormwater to areas within the gravel pit in order to keep the <br />stormwater from leaving the pit rapidly. The structures will be keep in place until <br />which time the mining has concluded and reclamation has contoured the land to a <br />finished grade compatible to keep the historical runoff from causing any <br />sedimentation into the waterways in the area. Earthen berms will be used; no <br />concrete or other materials that would require demolition and removal from the <br />site are to be used for the purpose mentioned above. The number of the berms will <br />be established per Best Management Practices (BMPs) that will be known when <br />mining starts. However the applicant / operator will before mining in the areas <br />that have the drainways place earthen berms on each side of them to keep any <br />stormwater from entering the drainages. This is will be done as a planned item <br />before moving into such areas. <br />9.) The applicant / operator will not do any blasting at this site. This is an alluvium <br />gravel deposit and blasting would not be useful to loosen the raw materials. <br />10.) The Mining Plan Map did not show the two (2) drainages that bi-sect the permit area. <br />This was an error on my part they now appear on the map. The drainages will be <br />protected by earthen berms that will be constructed along the sides of the drainages both <br />sides will be built to keep stromwater out of the drainages. This will keep the stromwater <br />from entering the drainages and preserving the hydrological balance of both the surface <br />and ground water that is historical. Damage to the drainages will be minimal and no <br />mining will be done in the drainways. This will keep the water flows on the surface <br />normal and will not affect the ground water in the surrounding area. <br />The reclamation contouring will be done in a manner to protect the historical <br />flows of the surface water by blending the surface of the mined areas in such a <br />way to establish gentile slopes and to make areas that will retain stromwater. <br />for less than 72 hours per storm event. <br />A Stromwater Permit will be obtained for this mine site and a Storm Water <br />Management Plan has been created for the purpose of retaining the hydrological <br />balance. <br />11.) Exhibit "C" the Mining Plan Map as been revised to show the drainages. <br />The earthen berms are also shown for clarification.
