Please discuss how damages to these drainages will <br />be minimized during the mining process and how overland flow will be restored during <br />reclamation. <br />11.) Rule 6.4.7 (2) (a) requires that the above mentioned drainages be located on the mine <br />plan map for Exhibit C. <br />6.4.5 EXHIBIT E - Reclamation Plan <br />1.) As mentioned above, the overburden will need to be spread over the graded area first prior to <br />the placement of topsoil. Please specify the range of depth the overburden will be spread and the <br />range of depths the topsoil will be spread over the disturbed area. <br />2.) In the reclamation plan under section 2 (a) it states, "A special Use Permit (SUP) application <br />as been "GRANTED" by the Las Animas County Planning and Land Use Office and the Las <br />Animas County Commissioners for gravel mining at this location." On October 28", 2008 the <br />Office received a letter of concern regarding this application from a Mr. Valdez of the Las <br />Animas County Planning and Land Use Office. Based off the letter and a phone conversation <br />with Mr. Valdez, he indicated that on the "Addendum Rule 1.6.2 (1) (a)" notice of filing the <br />application with the Board of County Commissioners, it states that the site will be reclaimed as <br />"incised lakes and rangeland use" (a copy of this notice is enclosed). Please explain this <br />discrepancy with the proposed post mine land use. <br />Also, the letter indicated that the approved acreage for the Special Use Permit differed from the <br />amount of acreage that is applied for in this 112 (c) permit application. However, it appears that <br />the actual amount of land that will be mined is less than what was approved in the special use <br />permit. Based of this information, the Division believes you have addressed that issue. The <br />letter of concern is enclosed with this document. <br />3.) Also under the Revegetation section 3.1.10 of the submitted reclamation plan under (9), in <br />regards to adverse surface characteristics that may make reclamation measures impossible, does <br />the applicant believe that any such characteristics exist on the proposed permit area? <br />4.) Please indicate what man-made structures will remain on the site once reclamation is <br />complete? <br />5.) The NRCS seeding document indicates that the operator should conduct a soil test to <br />determine the type and the amount of fertilizer that will be used for reclamation. Please commit <br />to conducting a soil test to determine the type and amount of fertilizer that needs to be used prior <br />to applying any fertilizer during reclamation. <br />6.4.12 EXHIBIT L - Reclamation Costs <br />1.) The Division will need some more information to calculate the required bond: <br />a.) First, at the greatest level of disturbance, will the pit highwall only be 400 linear <br />feet? What will be the average height of the highwall? <br />b.) Given that the haul roads are to remain on the site after reclamation is <br />complete, approximately how many acres of the maximum disturbed area on average will <br />3
