2.) During the pre-operation inspection conducted on December 29th, 2008, two significant
drainages were observed within the permit area. These drainages were not identified on the
Mine Plan Map (Exhibit Q. Please include these drainage features on this map.
6.4.4 EXHIBIT D - Minim Plan
1.) Within the mining plan, it states that the area disturbed would not exceed 20 acres at any one
time. Once 20 acres of land has been disturbed, the operator would have to fully reclaim some
amount of acreage, and that acreage would have to be released by the Division or the affected
area and the financial warranty will need to be adjusted prior to disturbing more than 20 acres.
Given the timetable outlined on the mine plan map, is 20 acres enough of an area to be disturbed
at any one time?
2.) Please indicate what equipment will be used to process the mined material. Also, will any
facilities and structures be installed in the processing area to facilitate processing? If so, please
indicate their dimensions, and the type and thickness of the material they are built on.
3.) Please indicate if there will be a working face or highwall during the mining process. If so,
what will be the height and length of the highwall at the time of the greatest amount of
disturbance?
4.) Under section F of the mine plan it states, "The backsloping and final pit floor will be done at
the same time as mining." Please clarify this statement; please explain what it means how it will
be done.
5.) Also, under section F (i) of the mine plan, it states that there is 0-6 inches of topsoil, and that
some overburden will be used to supplement the topsoil and will be used as growth media. In
order to maintain the integrity of the topsoil, the overburden should be stripped and stored
separately from the topsoil. During reclamation, the overburden should be spread over the graded
area first, and then the topsoil should be spread over that. Please indicate the thickness of the
overburden that will be salvaged under the topsoil. Please display where the overburden
stockpiles will be located on the mine plan map in Exhibit C.
6.) Will the maximum pit depth be 18 feet? If not, what will be the maximum pit depth?
7.) There appears to be many man made structures within the permit boundary such as gas wells
and lines, roads, power lines and fences. Please describe how these structures will be protected
from damage during the mining operation. Also, will the operator maintain a setback from these
structures?
8.) It states in the mine plan that water diversion structures will be installed for storm water
management. Please describe these structures. How many of them will there be, what will be
their dimensions and where will they be installed?
9.) Will the operator use any explosives or blasting techniques during the mining process?
10.) During the pre-operation inspection conducted on December 29th, 2008, two significant
drainages were observed within the permit area. These drainages were not identified on the Mine
Plan Map (Exhibit C) and they are not discussed in the mine plan. In accordance with Rule
3.1.6 disturbances to the privileging hydrologic balance of both the surface and ground
2
