In regards to the gas wells and lines owned by Pioneer Natural Resources USA, Inc. It <br />appears that a draft agreement has been submitted with the application and that the gas company <br />is in the process of signing the agreement. Please commit to not mining within 200 feet of the gas <br />lines and wells until the damage agreement has been signed and notarized by both parties. Or, <br />submit the signed agreement prior to the decision date for this application. <br />This concludes the Division's preliminary adequacy review of this application. Please remember <br />that the decision date for this application is February 14`h, 2008. As previously mentioned if you <br />are unable to provide satisfactory responses to any inadequacies prior to this date, it will be your <br />responsibility to request an extension of time to allow for continued review of this <br />application. If there are still unresolved issues when the decision date arrives and no extension <br />has been requested, the application will be denied.
