The sump was stable at the time of the inspection. <br /> - Sump 2 contained water approximately 1 foot below the top and was not <br /> discharging at the time of the inspection. The sump was stable at the time of the <br /> inspection. This sump was just cleaned and is cleaned on a regular basis by the road <br /> crew. <br /> - Sump 3 contained water approximately three feet below the top and was not <br /> discharging at the time of the inspection. The sump was stable at the time of the <br /> inspection. This sump was just cleaned and is cleaned on a regular basis by the road <br /> crew. <br /> - Sump 4 contained water approximately three feet below the top of the sump and <br /> was not discharging at the time of the inspection. The sump was stable at the time of <br /> the inspection. This sump was being cleaned at the time of the inspection (and is <br /> cleaned on a regular basis by the road crew). <br /> - Sump 5 contained water to the top of the sump but was not discharging at the time <br /> of the inspection. The sump appeared to be stable at the time of the inspection. This <br /> sump was scheduled to be cleaned after sump 4 was complete. The operator <br /> expressed concern with this sump. What happens is that as the sump fills, it does not <br /> discharge well since the top of the sump is at the same elevation as the surrounding <br /> land almost to Taylor Creek. This causes water to back up across the road (which is <br /> lower at that point to allow it to flow into the sump) and into the ditch along the <br /> Taylor Creek road. This standing water causes a permanent muddy spot in the road. <br /> Colowyo will consider the options for resolving this problem and submit a revision to <br /> the Division as necessary. <br /> Backfilling and Grading: - Colowyo did not perform any backfilling or regrading <br /> activities in the East Pit in 2008. They have performed some maintenance work in the <br /> Prospect drainage, however, as a result of abatement requirements for Notice of <br /> Violation CV-2008-004. The work in the drainage includes filling two large gullies that <br /> formed on the sides of the Prospect ditch (one gulley on each side of the ditch), <br /> repairing the erosion in the portions of the Prospect ditch that are at final grade <br /> (including replacing the riprap as necessary), installing contour ditches to slow the <br /> runoff on in the drainage and route it to the Prospect ditch and ripping the area <br /> between the ditches on contour. <br /> - Colowyo has committed to provide two reclamation schedules for the East Pit <br /> closure. The first plan is a short term plan that will encompass the area around the <br /> Prospect ditch, including the sump area that is part of the ditch which is not yet to <br /> final grade. This short term plan, in the form of a Technical Revision, is due to the <br /> Division no later than 24 December 2008. The second plan is a long term plan that <br /> will provide a comprehensive reclamation schedule for the remaining East Pit, <br /> including the closure of the final pit. This long term plan is due to the Division in the <br /> first quarter of 2009. <br /> - Colowyo completed 42.2 acres of reclamation in the West Pit in 2008. This leaves <br /> Colowyo approximately 430 acres behind on their permit commitment for the <br /> reclamation scheduled for completion by the end of 2007. <br />
