III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> • Minor channel erosion was noted along a short segment of PM-6 above Stock Pond T-32, upstream of <br /> the riprapped section. This section was marked on the 2008 Rill and Gully Survey Repair Map, but no <br /> work has yet been conducted. An approximate 100 foot section was intermittently eroded up to 18 <br /> inches deep; the gully is beginning to recover naturally, but minor maintenance such as hand <br /> placed rock checks or similar measures would facilitate recovery, and is recommended. <br /> Disturbance associated with equipment access and repair work would probably be counter-productive in <br /> this location. <br /> • A short gully segment immediately adjacent to South Road B, north of Pond 008, has not yet been <br /> repaired, and maintenance including riprap or rock check installation would appear to be <br /> warranted to prevent possible headcutting. <br /> • An intermittent gully up to 2 feet deep on reclaimed steep south facing slope in the Pond 4 watershed, <br /> north of the South Road, was properly graded and repaired. <br /> • A gully caused by an old temporary diversion around a shrub planting site, above Road F, south of Stock <br /> Pond T-30, was inadvertently not checked during the inspection. The SL-3 inspection noted that both <br /> the old diversion and the resulting gully would need to be repaired. This location will be re-checked <br /> by the Division during the next site inspection. <br /> • A road ditch outlet below the junction of Road C and Road F had eroded in the past, and in the SL-3 <br /> inspection, stabilization measures were requested by the Division. The location was re-checked during <br /> the October 16 inspection, and the determination was made that the location appears to be stabilizing on <br /> its own, and that it should be monitored, but no remedial work is necessary at present. <br /> • A small slump that occurred within the bond release area in a former topsoil stockpile location, <br /> immediately to the west of Channel PM-10, approximately 100 yards north of a gully reclaimed in 2007 <br /> with TRM installation, had been properly graded to eliminate the slump scarp and blend the feature back <br /> into the surrounding terrain. <br /> Comments Not Related to the SL-3 Bond Release <br /> • In the inspection report dated June 5, 2008, which was written based on review of aerial photos taken <br /> during a flight of May 29, 2008, the Division noted the presence of"an apparent sinkhole type feature", <br /> located near the perimeter of the reclaimed area, north of Pond 008, east of the South Road Crossing <br /> of Channel PM-8. In fact, the feature was not a"sinkhole", but was a small slump, which was <br /> subsequently documented by the operator in the Rill and Gully Survey Map. The slump had been <br /> properly graded and reclaimed prior to the October 2008 inspection. The slump was located within the <br /> 125.8 acre"East Wadge Pit Area", which was excluded from the SL-1 Phase 1 bond release, and was <br /> not included in the SL-3 Phase 2 bond release area. <br /> • Substantial gully repair grading has occurred on the steep slope of the East Wadge Pit Area in the last <br /> couple years, and a series of cross-slope V ditches were constructed to divert slope drainage into <br /> Channel PM-8; to minimize further slope erosion. One concern was noted within this area during <br /> this inspection. A corridor or flow path perhaps 40 to 60 feet wide with a high density of rills <br /> and gullies was observed on the slope between V Ditch #3 and V Ditch#4. The gullies are <br /> apparently remnant from erosion that occurred prior to ditch construction. Further grading, <br /> slope roughening, and seeding appears to be warranted in this location. <br /> • An area of reclaimed Wolf Creek"pre-law" spoils in the northern portion of the permit area, which had <br /> been excluded from the SL-2"pre-law" bond release was inspected. The excluded area <br /> encompasses approximately 68+acres (including small areas associated with access and drainage <br /> construction adjacent to the Wolf Creek Pit area). The area was excluded from the SL-2 bond release <br /> due to poor vegetation establishment, extensive slope erosion, and impoundment of low pH water <br /> within a pond in the location of the final mine pit. The problems were due to steep slopes and acid <br /> forming surficial spoils. Remedial grading was conducted in 2007, to repair erosion damage, and <br /> eliminate ponding by establishing positive grade in the final pit area. The remedial project also <br /> included construction of a new drainage channel (PL-1)downstream of the Wolf <br /> 4 <br />
