III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> General Comments <br /> This was a complete inspection of the Seneca II Mine, conducted by Dan Mathews of the DRMS Grand Junction <br /> office. Records were checked on the afternoon of October 15;field inspection was conducted on the morning of <br /> October 16 and the morning of October 17. .Sandy Brown of the DRMS Denver office was present during most <br /> of the field inspection. Dennis Jones of SCC was present during the entire inspection. <br /> Availability of Records <br /> Records were checked at the mine office on the afternoon of 10/15/08, and were found to be complete and up- <br /> to-date. <br /> Roads <br /> Permit area roads were dry and properly maintained. As noted in the previous inspection, a series of large water <br /> bars was installed earlier this summer along a steep section of the South Road, between Pond 004 and Pond <br /> 008. The Division had identified erosion along the South Road ditch as a concern during the SL-3 bond release <br /> inspection in July, and the water bars were installed subsequent to the SL-3 inspection. <br /> Hydrologic Balance <br /> Sediment Ponds 002, 003, 004, 008, and the Pecoco Impoundment were inspected. No problems were evident; <br /> all of the ponds were discharging clear water. <br /> Small area exemption silt fencing in various locations around the perimeter of the gravel yard area across the <br /> road from the shop had been damaged by snow accumulation over the winter; and the silt fencing had been <br /> replaced by straw wattles earlier this spring. The straw wattles appeared to be properly installed and should be <br /> sufficient to control sedimentation from the small gravel yard area. <br /> At the shop area, scattered items of trash and debris (plastic bags, plywood panels, cardboard, etc.)were noted <br /> along and adjacent to the perimeter collection ditch (which leads to Pond 003). Also, there were a couple low <br /> spots in the perimeter berm along the outside edge of the collection ditch, along the west side of the shop area, <br /> where build up of the berm adjacent to the ditch appears to be warranted. Necessary maintenance and clean- <br /> up of the perimeter ditch should be performed by the end of November. <br /> Backfill and Grading and Reclamation Success <br /> A number of gullies, slumps, and other features were identified in the SL-3 bond release inspection report of 8- <br /> 18-08. SCC has performed significant remedial work addressing these items of concern, although some <br /> maintenance work remains to be done. Current status of concerns noted in the SL-3 inspection, based on <br /> observations made during the October 15-17 inspection are as follows: <br /> Items of Concern from SL-3 Inspection (within the bond release request area) <br /> • South Road ditch erosion was properly addressed by installation of large water bars(see"Roads" <br /> above). <br /> • Gully below Road E1 that flows into the upper reach of Channel PM-22 was properly graded, and in <br /> addition, water bars were properly installed along a section of the road and across a cow trail up- <br /> gradient from the repaired gully, to disperse concentrated flow. <br /> An open drill hole previously located along a fenceline in the reclaimed spoil due south of Channel PM- <br /> 6B (near Stock Pond T-32), could not be located and has apparently been backfilled. <br /> 3 <br />
