XVI. Explosives - Rules 2.05.3(6) and 4.08 <br /> According to the operations plan, blasting will not occur on a regular basis. <br /> Occasional use of explosives during facilities construction was approved in <br /> Minor Revision 1 in June, 1985. <br /> The operation is in compliance with the requirements of this section. <br /> XVII. Backfilling and Grading - Rules 2.05.3(9) , 2.05.4(2)(c) , 4.09 and 4.14 <br /> On April 3, 1985, Eastside submitted an analytical demonstration of the slope <br /> stability of the proposed post-mining topography at the mine site, in response <br /> to Stipulation No. 8. Division approval was granted in a letter to the <br /> permittee dated May 9, 1985. <br /> In the same April 3, 1985 correspondence, the permittee responded to <br /> Stipulation No. 9 by replacing the pipe drain design for outfall of refuse <br /> pile drainage with a design for a gravel drain. This response was accepted by <br /> the Division in the same May 9, 1985 letter to Eastside Coal Company. <br /> The operation is in compliance with the requirements of this section. <br /> XVIII. Mine Facilities, Coal - Handling Structures, Support Facilities - Rules <br /> and 4.04 <br /> The discussion in this section of the original Findings Document remains <br /> valid. The only change in this section involves approval of the loadout <br /> facility in Rifle, Colorado (Technical Revision 2) . Construction of many of <br /> the facilities (loadout, conveyor and screening facility, planned office area, <br /> and refuse pile) has been delayed due to mine inactivity. <br /> The operation is in compliance with the requirements of this section. <br /> XIX. Underground Development Waste, Coal Processing Waste, and Non-Coal <br /> Processing Waste - Rules , an 4.11 <br /> Stipulation No. 10 required Eastside Coal Company to submit a plan for storage <br /> and disposal of non-coal waste. Revised page 108 of the permit application <br /> states that such wastes will be disposed of in county dumps. Stipulation <br /> No. 10 is therefore satisfied. This section of the original Findings Document <br /> is otherwise still valid. <br /> The operation is in compliance with the requirements of this section. <br /> XX. Roads - Rules 2:05.4(3) and 4.03 <br /> No changes are required. The operation is in compliance with the requirements <br /> of this section. <br /> -10- <br />
