U. Topsoil - Rules 2.04.9, 2.05.3(5), 2.05.4(2)(d), and 4.06 <br /> Estimates of salvageable topsoil quality and volume did not chance during the <br /> first permit term. As Eastside has yet to develop the proposed office and <br /> refuse disposal areas, no topsoil has been salvaged to date. <br /> The operation is in compliance with the requirements of this section. <br /> XII. Vegetation - Rules 2.04.10, 2.05.4(2)(e) , and 4.15 <br /> Stipulation No. 5 in the original Findings Document was satisfied by the <br /> submittal of a replacement permit application page committing Eastside to a <br /> 35% revegetation cover standard. <br /> Minor Revision 2 was approved by the Division in February, 1986, and added the <br /> species Poa ampla (Big Bluegrass) , Artemisia friqida (Fringed Sage), and <br /> Penstemon stric us (Rocky Mountain penstemon) to tie revegetation seed mix. <br /> e'f�r o Stipulation No. 6, requiring revision of the applicant's seed mix, <br /> is satisfied. <br /> No other changes to this section are required. The operation is in compliance <br /> with the requirements of this section. <br /> XIII. Fish and Wildlife - Rules 2.04.11 , 2.05.6(2) , and 4.18 <br /> Stipulation No. 7 of the original Findings Document required Eastside Coal <br /> Company to submit information concerning power line construction and raptor <br /> protection (Rule 4.18(4) ). The stipulation was satisfied by a letter to the <br /> Division from a Public Service Company representative dated February 25, 1985 <br /> concerning design of the existing power lines in the permit area. <br /> No other changes are required. The operation is in compliance with the <br /> requirements of this section. <br /> XIV. Prime Farmlands - Rules 2.04.12, 2.06.6, and 4.25 <br /> There are no changes to this section. The operation is in compliance with the <br /> requirements of this section. <br /> XV. Operations Description - Rules 2.05.3, 2.05.3(1 ), 2.05.3(2) and 4.01 <br /> The proposed method of mining at Eastside, discussed in the original Findings <br /> Document, has not been modified. Due to extensive periods of inactivity <br /> during the first permit term, the planned relocation of surface facilities, <br /> expansion of the coal storage area, and construction of the refuse disposal <br /> has not occurred. Approval of Minor Revision 4 in May, 1987 allowed temporary <br /> storage of coal waste in part of the portal yard area. <br /> As previously mentioned, a railroad loadout facility in the town of Rifle was <br /> approved by the Division in October, 1987 (Technical Revision 2) but has yet <br /> to be constructed. <br /> The operation is in compliance with the requirements of this section. <br /> -9- <br />
