In the submittal dated August 11, 2008, BRL requested that the Division's original reclamation cost <br />estimate be reduced since the monitoring well originally planned in TR-53 was bonded for and drilled <br />in MR-86. Attached is the Division's revised reclamation cost estimate. Please inform the Division in <br />writing whether or not the estimate is acceptable to BRL. <br />Section 4.05.10, Underground Mine Entry and Access Discharges <br />9. Please demonstrate compliance with Rule 4.05.10(2), if applicable. <br />The Division has no further concerns. In the August 11, 2008 submittal, BRL responded that no <br />gravity discharge of mine water will take place. However, as explained previously in this letter, there <br />will not be any mine water diversion or discharge approved in TR-53. <br />Section 4.05.16, Discharge of Water into an Underground Mine <br />10. Please demonstrate compliance with Rule 4.05.16(4) for discharges of underground water to the <br />surface. <br />The Division has no further concerns. In the submittal dated August 1, 2008, BRL responded that the <br />permitting of the discharge of mine water will be handled in TR-54. In addition, as described above, <br />TR-53 has been revised further so that no mine water will be diverted or discharged. The diversion as <br />well as the discharge of mine water will be handled in TR-54. <br />Public and Other Agency Comments <br />11. Attached is a comment letter that the Division received from the Colorado Division of Water <br />Resources concerning TR-53. That agency has no concerns with the proposed activities provided that <br />the pumped water is not used in any way and that it is discharged to Hubbard Creek as proposed. If <br />and when any additional comment letters are received, they will be forwarded to BRL. <br />As explained above, TR-53 has been modified so that only the drilling of the dewatering well and <br />the construction of the pipeline will be handled in TR-53.
