II) Exhibit B-Index Map-Rule 6.4.2 <br />• This section is adequate as submitted. <br />Response. <br />Thank you in your assessment that concluded that the Index Map - Rule 6.4.2 was adequate <br />as submitted in the MLE Project Application. <br />III) Exhibit C-Pre-Mining and Mining Plan Maps-Rule 6.4.3 <br />A. Has the operator identified all owners of records of adjacent lands in Drawing C-1? This <br />map does not have the description of the purple colored land owner along the North Side <br />of the permit area. In addition, please verify that all the colors depicted on the map <br />correlate to the colors listed on the map legend. <br />Response. <br />As noted on Drawing C-1, the ownership shown is based on extensive research by CC&V and <br />is accurate to the best of CC&V's knowledge based on the information available through the <br />Teller County Assessor's Database, which contains all recorded property transactions. All <br />owners of record within 200 feet of the permit boundary are identified by numeric index <br />number on the map that corresponds to mailing information on the associated spread sheet. <br />Please note that areas within 200 feet of the permit boundary where no third party owners are <br />• shown are owned or controlled by CC&V. While the originally submitted Drawing C-1 was <br />accurate, we include a revised Drawing C-1 as Attachment 2. This revised drawing has the <br />color coding removed. Adjacent land owners are referred by MISD number and listed in <br />Exhibit O. As indicated in the legend, the color coding associated with the drawing is for <br />adjacent man-made structures within 200 feet. <br />B. Drawing C-1a is labeled as permit boundary, adjacent land owners and permanent man- <br />made structures within 200 feet (within Victor city limits). Are there any man made <br />structures with in 200 feet of the City of Cripple Creek, other than the old mine structures? <br />Why is the tourist railroad track located within the permit area not noted as a structure in <br />drawing C-1? Does CC&V own the rail road trucks? Please explain. <br />Response. <br />The proposed Amendment No. 9 permit area does not come within 200 feet of the City of <br />Cripple Creek. CC&V has met the regulatory obligation in the Application to identify <br />landowners within 200 feet of the proposed permit boundary. CC&V does not own the tourist <br />railroad, and is not proposing under Amendment No. 9 any new activities within 200 feet of <br />the tourist railroad; thus, the depiction of the non-CC&V owned area on Drawing CA is <br />appropriate. <br />0C. Drawing C-4a, which is an aerial photograph of the permit area, has the permit boundary <br />and all the. facilities inked in red, blue and yellow lines. However, there is no legend <br />explaining these different colored identifiers. It would help the reader if a legend such as <br />the one submitted in AM-08 map labeled Permit Boundary was included. Please submit this <br />4
