III. COMMENTS- COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> July inspection. Additional cleanout of this ditch is needed. Ditch E-2 east of the zero entry shaft has <br /> been cleaned out, and is sufficient. Most of the ditches were dry. TCC has been conducting <br /> maintenance throughout the mine site. <br /> The NW B-O-B ditch continues to require to be cleaned out. Coal has been pushed into this ditch but all <br /> material will drain to Pond B. Visual markers may assist the dozer operator in seeing the limits of the <br /> pile. Maintenance of the BOB NW ditch needs to occur prior to winter months. <br /> TCC has graded the area south of the Wash Plant II. The ditch south of the wash plant has been mostly <br /> re-established. TCC has not established a sump on the west side of Wash Plant I1. The thickener <br /> overflow sump has not been utilized and is currently dry. 2 culverts were in place under the western <br /> access ramp to the area by the thickener tank. These 2 culverts drain the low area south of Wash Plant II <br /> as well as handle the ditch drainage to Pond D. The ramp over the east portion of this ditch does have a <br /> single culvert through the ramp. However, this culvert is clogged and no information has been provided <br /> regarding the sizing of this culvert. TCC either needs to remove the ramp and re-establish the ditch, or <br /> demonstrate proper sizing of the culvert and assure the culvert is clear of sediment. <br /> Coal material had previously been pushed outside of the berm at the Train Load Out. On 8/27 efforts to <br /> re-establish a ditch along the perimeter of the Train Load out area had resulted in a trench. The trench <br /> ranged from—6 inches deep on the east side to—4 foot deep at the deepest point. Discussions with the <br /> operator clarified that a trench was not intended to be a collection ditch. (Photo 1) The operator met with <br /> the contractor to communicate the desired ditch configuration. On 8/28 the inspector revisited the train <br /> loadout site. A front end loader was actively reshaping the trench and re-establishing a shallow ditch. <br /> Care was being taken to pull coaly material to the south of the ditch, and to re-establish the grade for <br /> positive drainage. The ditch connects to an existing ditch and rock check dam. (Photo 2). These repairs <br /> are progressing and appear to be meeting the intended purpose of the ditch.
