III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. Mr. Joe Shoemaker of Twentymile Coal Company accompanied the inspection. The mine is <br /> an active underground mine. The weather was hot and windy, and the mine site was dry. The mine is <br /> temporarily not producing coal due to hydrologic concerns in the mine. <br /> Roads: Roads throughout the mine were dry and well graded. 6MN access road remains in good <br /> condition. Roadside ditches are getting regraded and haulroad SAE's cleaned of sediment. <br /> The hydraulic oil spill on the 6MN pad near the pump house is mostly cleaned up. The berm downslope <br /> of the hydraulic oil spill remains intact. TCC continues to clean the leak from the compressor building. <br /> TCC has received approval to dispose of contaminated soil material at the landfill outside of Milner. <br /> (The Division has not seen documentation on this approval.) TCC is in the process of dismantling this <br /> temporary compressor house, decommissioning the leaking compressor and replacing the equipment. <br /> Hydraulic oil does not reach the 6MN pond, though TCC continues to place absorbent napkins and <br /> booms in the inlet of the 6MN pond. Water level in the 6MN pond had receded and water level is well <br /> below the discharge elevation. <br /> Support Facilities: The Division proposed to approve the revision to the Stoker loading area, TR 65, on <br /> 8/22/2008. No truck loading was occurring during the time of this inspection. <br /> Hydrologic Balance: <br /> TCC is currently not extracting coal due to concerns about underground water elevation up against seals <br /> with in the mine. Extraction has been halted since 8/25. TCC has contacted the Division regarding <br /> discharge from the Fish Creek Borehole. TCC has concerns that discharge would exceed the 1500 ppm <br /> TDS at site 115 (Fish Creek Borehole). TCC consulted with Division hydrologist, Kent Gorham, and <br /> Coal Program supervisor regarding exception for this discharge. DRMS requires that standards are met <br /> at downstream site 1005, TCC conducts increased water monitoring, and provide a revision to the permit <br /> to DRMS. The inspector collected a water sample at site 1005 at 11:30 am 8/28/2008 for confirmation <br /> of EC and sulfate values. <br /> TCC is considering long-term management of underground water. TCC is currently pumping to Pit 1. <br /> Pit 1 elevation has 10 feet approx elevation prior to flowing to Pond D. Pond D was not discharging <br /> during this inspection. <br /> Ponds throughout the mine site were holding water,though few of the ponds were discharging. TCC is <br /> working with the CDPH&E to permit pond 6MN with an outfall point. This change to the pond <br /> configuration will also need to be permitted with DRMS. <br /> Most of the ditches through out the mine site were in good condition. TCC has been working on <br /> maintenance of ditches in the mine area. Haul road C ditch has received additional sediment since the <br /> 3 of 6 WHITE- File YELLOW-Operator PINK-Specialist <br />
