An approximate date for purposed activity to commence and end: <br />Commencement is expected by April 14th, 2008; anticipated end date is June <br />2008. <br />Signed affidavit certifying that the material is clean and inert: <br />Certification of Fill Material <br />I, Amory Quinn, certify that the proposed fill materials identified under Item B of <br />this Notice are clean and inert as defined in Rule 1.1(24) of the State of Colorado <br />Hard Rock/Metal Mining Rules and Regulations. "Inert Materials"{ means non- <br />water soluble and non-putrescible solids together with such minor amounts and <br />types of other materials, unless such materials are acid or toxic producing, as will <br />not significantly affect the inert nature of such solids. The term includes, but is <br />not limited to, earth, sand, gravel, rock, concrete which has been in a hardened <br />state for at least sixty days, masonry, asphalt paving fragments, and other inert <br />solids}. The minor amounts and types of other materials present in the listed fill <br />materials are very similar in type and chemical concentrations of materials that <br />exist naturally in the fill location. The proposed fill materials do not contain any <br />acid or toxic producing materials. The information contained in this Notice of <br />proposed deposition activity is true and complete to the best of my knowledge <br />and belief. <br />Cotter Corp <br />E. Explanation of how the activity will result in apost-mining <br />configuration that is compatible with the approved reclamation plan and <br />post-mining land use: <br />The post-mining configuration of the filled site will have no effect on the post- <br />mining land use since the filled site will be entirely underground, with no <br />connection between the filled material and ground surface.
