The <br />underground excavation is not subject to the instability and exposure problems <br />associated with an aboveground excavated pit which is specifically addressed by <br />the notice requirements of Rule 3.1.5(9), Items A-F. However, absent a specific <br />ruling related to underground activity, the following information is provided in <br />response to the above cited rule: <br />A. Location of purposed activity: The proposed activity would occur within <br />a large, structurally stable underground stope area as a result from extraction of <br />uranium ore in the late 197O's. The specific location of the stope is provided in <br />attachment Figure A and vertical cross section view Figure B. The excavation <br />area is iocated above the maximum post -mine closure water level identified in <br />"Schwartzwalder Mine Hydrologic Evaluation of Mine Closure and Reclamation" <br />(Whetstone Associates, Inc., November, 2007). This stope is also above the <br />maximum post-mine closure water level identified in Appendix E-2, "Anticipated <br />Post-Mining Hydrology of the Schwartzwalder Mine Jefferson Co., Colorado," of <br />Permit M-77-300. <br />B. Material.Type: The following inert materials are included in the purposed <br />deposition activity.
