Attachment A <br />Conditions of Surface Use <br />Oxbow Mining LLC, TR-58, Methane Drainage <br />Administrative <br />1. The Operator shall notify the Forest Service at least one week before operations are to <br />commences on National Forest System (NFS) lands. In addition, the operator will notify the <br />Forest Service 48 hours in advance of mobilizing heavy equipment (including road <br />maintenance equipment) onto National Forest System lands. <br />2. The operator shall immediately cease operations in areas where any antiquities or other <br />objects of historic or cultural significance, or items of scientific interest are discovered. The <br />Operator :;hall bring discovery to the attention of th_e District Ranger. Any_such discoveries _ <br />_ sFiall be left intact until the operator is permitted to proceed~by the authorized officer. <br />Soils <br />3. Temporary roads and drill pads will be designed to minimize erosion and sedimentation. Pad <br />sites will bye sloped to drain spills and on-site precipitation into the mud pits. <br />4. Reclamation activities will commence immediately after drilling activities are complete. New <br />temporary roads will be decommissioned by obliteration once no longer needed for access. <br />The point of access (where applicable) will be blocked as directed by the Forest Service so <br />to prevent motorized use of the obliterated road. The USFS officer will identify barrier <br />locations and techniques. <br />Water Resources <br />5. No refueling or lubricating will take place within 100 feet of wetlands and other waterbodies <br />or live drainages. Heavy equipment, hazardous materials, chemicals, fuels, etc., will not be <br />stored witlhin 100 feet of wetlands or surface waters. <br />6. No soil generated from excavation, site preparation, or other operations shall be deposited <br />within 100 linear feet of any drainage with flowing water unless specifically approved by the <br />District Ranger. <br />Vegetation <br />7. No new surface disturbance will be allowed in wetland, floodplain, or riparian areas except as <br />specifically approved, or on existing transportation routes. <br />8. The Operator will be responsible for controlling noxious weed infestations on all NFS project <br />disturbance areas from the date of discovery up to the point of release of the CDRMS <br />reclamation bond and associated reclamation liability. Any herbicides used must be USFS <br />approved and will be applied at the recommended rates by a certified applicator in <br />compliance with State laws. <br />9. Any hay or straw used shall be certified as weed free. <br />10. Reseeding will be completed on disturbed soils, by the end of the first growing season, using <br />a certified weed free source of seed. Reseeding will be performed consistent with the <br />
